That
Council approve that:
1. By-law No. 2003-52,
the Signs on City Roads By-law, be amended to permit a rigid sign associated
with the Uth Ink project to be located on utility poles in the Hintonburg and
West Wellington communities provided that:
(a) the signs are provided to
the City at Uth Ink’s cost and placed by the City;
(b) where deemed necessary by
the Deputy City Manager of Public Works and Services, the City’s costs for
placing such signs shall be paid by Uth Ink;
(c) the signs shall only be
placed until July, 2011;
(d) permission is obtained from
the owner or lessee of the utility pole to which the sign will be
attached;
(e) specific fastening
instruction stipulated by the owner or lessee of the utility pole are complied
with; and
(f) the dimensions of the sign
are no greater than 12.7 cm in width and 30.48 cm in height and the lowest
extremity of the sign is at least 2m measured from the ground.
2. For the purposes of
this amendment, the Hintonburg community is the area bounded by Scott Street on
the north, on the east by the CPR rail corridor, on the south by Highway 417
and on the west by Holland Avenue and the West Wellington community is the area
bounded by Holland Avenue on the east, on the south by Highway 417, on the west
by Island Park Drive and on the north by Scott Street.

On 17 September 2008, at a joint meeting of the Transportation and Transit Committees, the Joint Committee agreed to suspend the rules of procedure to consider an item brought forward by Councillor Leadman. The extract of Minute, which contains the full text of the Motion, is appended as Document 1.
DISCUSSION
Uth Ink is a province wide program that gives youth a voice and sense of ownership of their community through artistic practices by writing, performing and recording theatrical pieces about their community. The program has been successfully completed in four other communities across Ontario.
In Ottawa, Uth Ink has partnered with the Great Canadian Theatre Company (GCTC) to put on a play-writing workshop. Each participant creates a community-themed play that is then recorded. A crucial part of the project is affixing green metal signs to telephone poles that list a playwright's first name and a phone number people can call to listen to the play. The signs are intended to offer a dramatic representation of the young person’s perspective on their neighbourhood and encourage the public to listen to a recording of the theatre piece.
The Signs on City Roads By-law currently does not permit rigid signs of this nature to be located on utility poles.
In
view of the fact that this project is of significant cultural benefit to the
youth of these two neighbourhoods, it is recommended that the by-law be amended
to allow the temporary installation (until 2011) of these signs on utility
poles in the community, as provided for by the conditions in the
recommendation.
By-law and Regulatory Services has no issue
with this amendment.
Legal Services staff has
reviewed the report and their comments have been incorporated.
As
noted by the recommendation, where deemed necessary by the Deputy City Manager
of Public Works and Services, the City’s costs for placing such signs shall be
paid by Uth Ink. Therefore, it is anticipated that there will be no cost to the
City.

Councillor Leadman indicated that she has been working with the Great Canadian Theatre Company and this group for many months to bring forward a unique opportunity to do something for the youth in the community. She confirmed that the Motion was crafted with the support of staff in Legal, By-law Services and Public Works and Services. She emphasized that there are to be strict measures put in place and that the signs are not permanent; they are small signs oriented to pedestrians.
Michael Flainek, Director of Traffic and Parking Operations Branch advised that staff would undertake Committee's and Council direction and did have some concerns about the number of sign placements. It was not clear within the documentation provided by the councillor, how many signs were to be erected. He confirmed staff would would work with the utilities with respect to the Motion. Ernest McArthur, Legal Counsel confirmed that the Motion meets the requirements of waiving the By-law.
Councillor Bédard indicated that he receives numerous requests to install signage in communities in his ward, but he rejects them because otherwise there will be signs everywhere. He posited that the by-law is there for a reason and while this request may be for a good cause, he felt approval would set a precedent for the City. He also wondered whether Ottawa Hydro has received this request because they usually remove signs posted on their poles.
While he understood these concerns, Councillor Legendre suggested that the provisos in the Motion provide comfort, noting that they still must seek the permission of the utility authority to install their signs. He liked the purpose of the signage, noting it is not the usual kind of advertising for performances and that because of the nature of the function, the signs would only be up until 2011. He believed the Committee should support this grass roots and experimental program.
In her closing comments, Councillor Leadman explained that the intent is very specific and the program will be focused in a very strategic area of the City in terms of the growth in it’s arts community and also an area that is in transition. She maintained that this is a time when the City needs to be flexible and to respond favourably when such opportunities arise.
