1.      Declare a parcel of land shown hatched on Annex “A” attached and identified as Parcels 1 to 6, containing a total area of approximately 1530.6m2 (0.378 acres), being part of the road allowance between Concessions 11 and 12, geographic Township of Goulbourn, closed by Township of Goulbourn By-law 39-95, described as Part 26, Plan 5R-13995, in the City of Ottawa, as surplus to the City’s needs; and

 

2.      Approve the sale of the land detailed in Recommendation 1, pursuant to Agreements of Purchase and Sale that have been received, as follows:

 

a)   Parcel 1 containing an approximate area of 178.8 m2 (1,924.6 square feet)   subject to final survey, to Cynthia Ann Sanoy, for the amount of $5,774.00, plus GST;

 

b)   Parcel 2 containing an approximate area of 184.0 m2 (1980.6 square feet) subject to final survey, to Alan D. Thomas and Sandra I. Thomas, for the amount of $5,941.00, plus GST;

 

c)   Parcel 5 containing an approximate area of 307.0 m2 (3,304.6 square feet) subject to final survey to, Karl Blomquist and Tracey Blomquist, for the amount of $9,914.00, plus GST; and

 

d)   Parcel 6 containing an area of 193.5 m2 (2,082.8 square feet) subject to final survey, to Derek and Patricia Teevens, for the amount of $ 3,124.00, plus GST, subject to an easement in favour of the City of Ottawa for drainage purposes.

BACKGROUND

 

The subject property is a landlocked parcel of land containing a total area of 1530.6 square metres.  The property was formerly part of the road allowance between Concessions 11 and 12, geographic Township of Goulbourn, described as Part 26, Plan 5R-13995.   The former Township of Goulbourn in 1995 enacted by-law 39-95 to close the road allowance described as Parts 1 through 28 and Part 31 on Plan 5R-13995.  All the portions of the road allowance were conveyed to the abutting owners, except for the subject portion described as Part 26, Plan 5R-13995. 

 

The subject portion of the closed road allowance is bordered to the north by 6310 Hazeldean Road, a commercially zoned property and to the south by residential properties.  The subject property was offered to the owners of the commercial property at 6310 Hazeldean Road in 1995.  The offer to purchase was declined and the property remained in City ownership. The owners of 6310 Hazeldean were again offered the opportunity to purchase the subject closed road allowance in 2006, however agreement as to the market value could not be reached.

 

The residential owners contacted the former Township in 1995 indicating their interest in acquiring this portion of the road when they heard the owners of 6310 Hazeldean did not elect to purchase the one-half of the road allowance abutting its property. For reasons unknown, the sale to the residential owners did not happen in 1995.  These owners recently reconfirmed their interest in purchasing the closed road allowance when the use of the commercial property at 6310 Hazeldean Road changed from its previous RV trailer sales operation to a Techno Bloc landscaping operation.  Recently several trees, which previously provided a buffer between the residential and commercial property, were removed from the commercial site, resulting in increased noise and nuisance to the residential properties on Crantham Crescent and Kyle Avenue.

 

Five of the six residential property owners on Crantham Crescent and Kyle Avenue whose rear yards abut this portion of the closed road allowance recently expressed interest in purchasing the property. However, due to personal and financial reasons, one of the owners has asked to delay their purchase.  It is hoped in time that the sixth abutting owner will decide to purchase the closed road behind their property, thus the reason for recommending that all six parcels be declared surplus at this time.

 

The lands being sold will be consolidated with the back yards of the abutting residential properties allowing the residential owners to control this area, retain the existing trees and landscape the area to buffer the noise from the commercial property on Hazeldean Road. 

 

 

DISCUSSION

 

Agreement has been reached with four of the abutting residential owners to purchase the closed road allowance.  As part of this agreement, the abutting owners have agreed to pay the cost of the new survey plan required to transfer title. 

 

Parcel 6 is being sold subject to an easement in favour of the City for drainage purposes.  The purchase price for Parcel 6 has been adjusted to reflect this easement.  

 

The sale prices for the property are as indicated in recommendation 2 and are supported by an in-house appraisal.  The purchasers have agreed to reimburse the City for legal survey costs in the amount of $2,500.

 

The sale prices for the road allowance are recommended for acceptance.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The subject property does not contain natural environment lands designated as significant in the Official Plan or areas identified in the Urban Natural Areas Environmental Evaluation Study (March 2006).  No significant implications to the natural environment have been identified for the proposed sale of this property to the adjacent residential property owners.

 

 

CONSULTATION

 

In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all City Departments, including the Housing Branch, Public Works and Services and Planning, Transit and the Environment, to determine if the road allowance should be retained for a City mandated program.  The Community Planning and Design Division of the Planning, Transit and the Environment Department was consulted with respect to the Greenspace Master Plan and they have no objection to the sale of this property.  The only requirement by a City Department is to retain a drainage easement over Parcel 6.

 

The utility companies were also circulated and no interest was expressed in the retention of an easement.

OFGAC advised they had no objection to the sale of the property but that trees deemed significant should be protected during the development process.  The land is being sold to the individual residential property owners and no development is contemplated.  The land will be incorporated into their already existing rear yards.

 

The ward Councillor is aware of the sale of this property to the abutting owners and supports staff’s recommendations

 

 

FINANCIAL IMPLICATIONS

 

The transactions represent revenue of $24,753 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.

DISPOSITION

 

Following Council’s approval, Real Property Asset Management and Legal Services Branches will finalize the sale transactions.
