In 1997, followed by an update in 1998, the former City of Nepean completed Phases 1 and 2 Class Environmental Assessment Report entitled “South Nepean Urban Area Master Servicing Study Environmental Study Report”. The Study examined the municipal servicing infrastructure requirements and the impact on the environment of this infrastructure for the area north of the Jock River, and south of Strandherd Drive. Generally speaking, Phases 1 and 2 of the Class Environmental Assessment process reviews the current environment, identifies the issues, and provides alternative servicing solutions that minimizes the impact on the environment. In accordance with this process, the Study recommended a large pond to modify the existing Foster Pond located west of Cedarview Road, and a modified Kennedy Burnett Pond situated west of Jockvale Road, illustrated in Document 1.
The area described above for the two ponds were included in the City’s 2004 comprehensive development charge review, identified as the Barrhaven South Urban Centre (SUC), and was established as an area-specific stormwater development charge area under By-law 2004-304.
In 2007, Council
approved the Barrhaven South Community Design Plan, along with a supporting
subwatershed Study entitled “Jock River Reach One Subwatershed Study”, as well
as the “Barrhaven South Master Servicing Study.” Both Studies followed the Class Environmental Assessment process,
which includes, among other things, the four-phased planning approach from
identifying the existing conditions, to developing and implementing the
preferred infrastructure strategy that supports environmentally sustainable
development. These newer studies
proposed refinements to the stormwater infrastructure strategy for the Foster
Pond, including splitting the proposed single large Foster Pond into two ponds
as well as providing a fish habitat pond.
However, the overall stormwater strategy remains consistent with respect
to the requirement for the Foster Ponds.
Consistent with previous servicing studies, the Kennedy Burnett pond
continues to be a requirement. Document
2 illustrates the updated Foster and Kennedy Burnett stormwater pond locations.
Recently, the Ontario Ministry of the Environment (MOE) has advised the City that both the existing Foster stormwater pond and Kennedy Burnett storm drain are not functioning at acceptable levels. MOE staff have expressed a strong desire for the City to proceed with the design and ultimate construction of both the Foster and Kennedy Burnett stormwater management ponds. Both ponds will improve performance of existing facilities, as well as facilitate continued growth pressures within the drainage areas.
To respond to the
MOE request and to assist in facilitating growth pressures, an Environmental
Assessment (EA), in accordance with the Environmental Assessment Act,
and a detailed design of the stormwater facilities is necessary. This process may take up to 18 months to
complete, after which the land requirements will be defined in sufficient
detail such that the City can commence discussions with various landowners on
land acquisition.
The existing Foster stormwater pond and Kennedy Burnett storm drain are currently not performing at a satisfactory level. Ministry of Environment staff have requested that the City advance the ultimate construction of both facilities in order to improve quality of effluent into the Jock River. The first step in advancing the construction of the facilities is to commence the Class EA Schedule B process pursuant to the Environmental Assessment Act, followed by detailed design.
Pursuant to the Environmental Assessment Act, public consultation is required at various stages of the EA process and will be undertaken accordingly. In order to deal with funding these initiatives, a public meeting will also be held at the Planning and Environment Committee meeting on August 18, 2008.
An estimated $700,000 is required to fund the cost of undertaking an EA and detailed design of the Foster and Kennedy Burnett stormwater management facilities. These ponds reside in the Barrhaven SUC stormwater charge area where development charges are currently being collected as building permits are issued. These funds will be used for capital infrastructure servicing needs within the area-specific development charge By-Law 2004-304. The City established specific reserve accounts to which the development charge relates, and reserve account 830248 has been set up for the Barrhaven SUC stormwater area, which at the time of writing this report, has a balance of $2,003,024. Subject to Council approval, these funds are available to undertake the EA and a new capital account must be established to fund this project.

This report will be forwarded to City Council for a decision on August 28, 2008. On approval of this report, Planning Branch staff will commence work on the terms of reference required for the EA Study and detailed design. Upon completion of the terms of reference, Planning Branch staff in conjunction with Supply Management will initiate a request for proposal to engage an engineering consultant to undertake the EA Study and detailed design.
