That the Planning and Environment Committee recommend Council approve an amendment to the Compliance Reports By-law 2003-69 to add a new rooming house order report service and associated fee, as detailed in Document 1.

l’environnement recommande au Conseil d’approuver une modification au Règlement
sur les rapports de conformité 2003-69 afin d’ajouter un nouveau service de
rapport d’ordonnance concernant les maisons de chambres et les droits connexes,
comme il est expliqué en détail dans le document 1.
On May 28, 2008, City Council approved a report from the Community and Protective Services Committee to amend the Licensing By-law, effective September 1, 2008, which will establish harmonized regulations for the licensing and regulating of rooming houses.
Details of the new regulations were passed and enacted by Council on June 11, 2008, under By-law Number 2008‑237.
As a result of the harmonization of the Licensing By-law - Rooming House, Building Code Services will be introducing a new service to meet the requirements for the licensing of rooming houses.
The proposed regulations require the provision of a report from the Chief Building Official confirming that there are no outstanding orders related to the building, which is a new requirement. Confirmation by the Chief Building Official (CBO) as to whether or not there are outstanding orders related to the building will ensure that any previously identified deficiencies related to illegal construction, structural integrity of the building, or plumbing are addressed prior to the issuance of a license. Any such deficiencies would not be addressed through inspections conducted by Fire Services or Property Standards. A fee of $40.00 for the Rooming House Compliance Report is necessary to ensure full cost recovery in accordance with legislation that took effect July 1, 2005, which requires that Building Code Services activities be self-funded. It is noted that the CBO report requirement is a one-time obligation for the applicant.
Consultation was not necessary as recommended technical changes are for administrative purposes and directed by Council.
A nominal fee will be established to be cost effective.

The Office of the City Clerk to consolidate this amendment into By‑law Number 2003-69. Building Code Services Branch to prepare administrative forms and procedures for new order compliance report service.
DRAFT TECHNICAL AMENDMENT DOCUMENT 1
BY-LAW NO. 2008 –
A by-law of the
City of Ottawa to amend By-law No. 2003-69, being the compliance reports
by-law, respecting the establishment of a Rooming House Compliance Report and
the associated fee for service.
The Council of the City of Ottawa enacts as follows:
1. By-law
No. 2003-69 entitled “A by-law of the City of Ottawa regulating compliance
reports and associated fees”, as amended, is amended by inserting the following
section immediately following Section 6:
6A. (1) Upon written request of an applicant for information regarding illegal construction, structural integrity of the building, or plumbing orders under the jurisdiction of the Director, the Director shall provide the requested information from available records.
(2) The information provided in accordance with subsection (1) shall be referred to as the Rooming House Compliance Report.
(3) The fee for the Rooming House Compliance Report provided in accordance with subsection (1) is set out in Schedule “A” attached hereto.
2. Schedule A of the said By-law No. 2003-69 is amended by adding the following item immediately following Item 6:
