colleges, in the year preceding the year of levy, pursuant to Section 323 (1);

A by-law
to levy $75.00 for each resident place in correctional institutions, pursuant
to Section 323 (2);
3)
A by-law
to levy $75.00 per rated bed in public hospitals or provincial mental health
facilities, pursuant to Section 323 (3); and
4) A by-law to levy $75.00 for each place in the provincial education institutions, pursuant to Section 323 (5)..

REPORT RECOMMENDATIONS
That the Corporate Services and Economic Development Committee recommend
to Council that the following by-laws, attached as Document 1, be enacted to
provide for the annual levy on institutions in accordance with Section 323 of
the Municipal Act, 2001 and Ontario Regulation 384/98:

A by-law
to levy $75.00 for each full-time student enrolled in universities and
colleges, in the year preceding the year of levy, pursuant to Section 323 (1);

A by-law
to levy $75.00 for each resident place in correctional institutions, pursuant
to Section 323 (2);
6)
A by-law
to levy $75.00 per rated bed in public hospitals or provincial mental health
facilities, pursuant to Section 323 (3); and

A by-law
to levy $75.00 for each place in the provincial education institutions,
pursuant to Section 323 (5).
RECOMMANDATIONS DU

Que le Comité des services organisationnels et
du développement économique recommande au Conseil de promulguer les règlements
mentionnés ci-après, joints au document 1, afin de permettre le prélèvement
annuel auprès des établissements visés à l'article 323 de la Loi de 2001 sur
les municipalités et au Règlement de l'Ontario 384/98;

Un
règlement visant à prélever 75 $ par étudiant à temps plein inscrit dans les
universités et collèges au cours de l'année précédant celle du prélèvement,
conformément au paragraphe 323 (1);

BACKGROUND
Under
Section 323 (1), (2), (3) and (5) of the Municipal Act 2001, S.O. 2001,
c. 25, as amended and as defined under Ontario Regulations 384/98; Amended
to O. Reg. 297/03, municipalities are entitled to levy an amount of $75.00
per full-time student in attendance at universities and colleges, $75.00 per resident
place in correctional institutions, $75.00 per bed in public hospitals and
$75.00 per place in provincial educational institutions. This has been the method of billing these
institutions for some time.
The Ministry of Municipal Affairs and Housing has provided, by letters dated May 07, 2008, a listing of capacities for the year 2007 for institutions designated as eligible for payment under Section 323 of the Municipal Act. The 2008 annual amount will generate revenue totalling $5,086,650.00. In 2007 this revenue was $4,933,125.00.
CONSULTATION
The Legal Services Branch has reviewed the report and concurs with the recommendations.
FINANCIAL IMPLICATIONS
The 2008 annual levy payable to the City of Ottawa is in the amount of $5,086,650.00, which is a $153,525.00 increase from the amount already accounted for during the budget preparation that was $4,933,125.00 (same as the 2007 revenue).
SUPPORTING DOCUMENTATION
Document 1 - Draft By-laws (4) to levy an annual amount upon colleges and universities, correctional institutions, public hospitals or provincial mental health facilities and provincial education institutions.
DISPOSITION
Revenue Division will invoice designated institutions to levy the 2008 annual amounts to be payable to the City of Ottawa on or after July 1, 2008.
BY-LAW NO. 2008 -
A by-law of the City of
Ottawa to levy an annual amount upon provincial education institutions for the
year 2008.
WHEREAS
pursuant to Section 323 (5) of the Municipal Act, 2001, S.O. 1990, c.
25, as amended, (the “Municipal Act, 2001”), the Council of a local
municipality may by by-law levy upon a provincial education institution situate
in the municipality an annual amount not exceeding the prescribed amount for
each place in such institution as determined by the Minister under whose
jurisdiction such institution falls;
AND WHEREAS pursuant to
Ontario Regulation 384/98, as amended, made under the Municipal Act, 2001, the
prescribed amount for the purpose of Section 323 (5) of the Act is $75.00 per
year;
AND WHEREAS City Council
has, in the past years, levied the maximum allowable amount on these
institutions;
AND WHEREAS City Council
considers it desirable to continue to levy the maximum allowable amount on
these institutions;
AND WHEREAS the capacity has been determined at Centre Jules-Léger as 70 places;
THEREFORE
the Council of the City of Ottawa enacts as follows:
1. There
will be levied upon the Centre Jules-Léger for 2008 an amount of $75.00 for
each of the 70 places in the provincial education institution, the annual
amount levied being $5,250.00.
2.
The amount levied
under this by-law shall be paid to the City of Ottawa on or after July 1, 2008.
3.
The amount levied
under this by-law shall be recovered in the same manner as municipal taxes are
recovered and is a special lien on the lands of the provincial education
institution pursuant to the provisions of section 349 of the Municipal Act,
2001.

BY-LAW NO. 2008 –
A by-law of the City of Ottawa to levy an
annual tax upon colleges and universities for the year 2008.
WHEREAS pursuant to Section 323 (1) of the Municipal
Act, 2001, S.O. 2001, c. 25, as amended, (the “Municipal Act,
2001”), the Council of a local municipality may by by-law levy upon a
university designated by the Minister of Training, Colleges and Universities or
a college of applied arts and technology, an annual tax not exceeding the
prescribed amount for each full-time student enrolled in such university or
college in the year preceding the year of levy, as determined by the Minister
of Training, Colleges and Universities;
AND WHEREAS
pursuant to Ontario Regulation 384/98, as amended, made under the Municipal
Act, 2001, the prescribed amount for the purpose of Section 323 (1) of the Act
is $75.00 per full-time student, per year;
AND WHEREAS
City Council has, in the past years, levied the maximum allowable amount on
these institutions;
AND WHEREAS
City Council considers it desirable to continue to levy the maximum allowable
amount on these institutions;
AND WHEREAS
the capacity of full-time student enrollment has been determined at:
(a)
Carleton
University has 19,206 students;
(b)
University of
Ottawa has 28,915 students;
(c)
University of
Ottawa Heart Institute has 131 students;
(d)
St. Paul's
University has 417 students;
(e)
Algonquin College
of Applied Arts and Technology has 11,807 students;
(f)
Dominican’s
College of Philosophy and Theology has 111 students; and
(g) La Cité Collégiale (Caat) has 3,234 students.
THEREFORE the Council of the City
of Ottawa enacts as follows:
1. There will be levied upon
the Carleton University for 2008 a tax of $75.00 for each of the 19,206
full-time students enrolled in the university, the annual tax levied being
$1,440,450.00.
2.
There will be
levied upon the University of Ottawa for 2008 a tax of $75.00 for each of the
28,915 full-time students enrolled in the university, the annual tax levied
being $2,168,625.00.
3.
There will be
levied upon the University of Ottawa Heart Institute for 2008 a tax of $75.00
for each of the 131 full-time students enrolled in the university, the annual
tax levied being $9,825.00.
4. There will be levied upon
the St. Paul's University for 2008 a tax of $75.00 for each of the 417
full-time students enrolled in the university, the annual tax levied being
$31,275.00.
5.
There will be
levied upon the Algonquin College of Applied Arts and Technology for 2008 a tax
of $75.00 for each of the 11,807 full-time students enrolled in the college,
the annual tax levied being $885,525.00.
6.
There will be
levied upon the Dominican’s College of Philosophy and Theology for 2008 a tax
of $75.00 for each of the 111 full-time students enrolled in the college, the
annual tax levied being $8,325.00.
7.
There will be
levied upon La Cité Collégiale (CAAT) for 2008 a tax of $75.00 for each of the
3,234 full-time students enrolled in the college, the annual tax levied being
$242,550.00.
8.
The taxes levied
under this by-law shall be paid to the City of Ottawa on or after July 1, 2008.
9.
The taxes levied
under this by-law are recovered in the same manner as municipal taxes are
recovered and are a special lien on the lands of the universities and colleges
pursuant to the provisions of section 349 of the Municipal Act, 2001.

A by-law of the City of
Ottawa to levy an annual amount upon Ottawa Carleton Detention Centre for the
year 2008.
WHEREAS
pursuant to Section 323 (2) of the Municipal Act, 2001, S.O. 2001, c.
25, as amended, (the “Municipal Act, 2001”), the Council of a local
municipality may by by-law levy upon a correctional institution designated by
the Minister of Community Safety and Correctional Services, or a training
school, or place of secure custody designated under subsection 85(2) of the Youth
Criminal Justice Act (Canada) and designated by the Minister Community and
Social Services, an annual amount not exceeding the prescribed amount for each
resident place in such institution or school in the year preceding the year of
levy, as determined by the Minister of Community Safety and Correctional
Services or the Minister of Community and Social Services, as the case may be;
AND WHEREAS pursuant to
Ontario Regulation 384/98, as amended, made under the Municipal Act, 2001, the
prescribed amount for the purpose of Section 323 (2) of the Act is $75.00 per
resident per year.
AND WHEREAS City Council
has, in the past years, levied the maximum allowable amount on these
institutions;
AND WHEREAS City Council considers it desirable to continue to levy the maximum allowable amount on these institutions;
AND WHEREAS the number of resident places has been determined at Ottawa Carleton Detention Centre as 552 resident places;
THEREFORE the Council of the City of Ottawa enacts as follows:
1.
There will be levied upon Ottawa Carleton
Detention Centre for 2008 an amount of $75.00 for each of the 552 residents placed in the institution, the annual amount levied
being $41,400.00.
2.
The amount levied
under this by-law shall be paid to the City of Ottawa on or after July 1, 2008.
3.
The amount levied
under this by-law shall be recovered in the same manner as municipal taxes are
recovered and is a special lien on the lands of the correctional institution
pursuant to the provisions of section 349 of the Municipal Act, 2001.

A by-law of the City of Ottawa to levy an annual amount upon public hospitals or provincial mental health facilities for the year 2008.
WHEREAS
pursuant to Section 323 (3) of the Municipal Act, 2001, S.O. 2001, c.
25, as amended, (the “Municipal Act, 2001”) the Council of a local municipality
may by by-law levy upon a public hospital or a provincial mental health
facility designated by the Minister of Health and Long-Term Care and situate in
the municipality, an annual amount not exceeding the prescribed amount for each
provincially rated bed in such public hospital or provincial mental health
facility, as determined by the Minister of Health and Long-Term Care;
AND WHEREAS
pursuant to Ontario Regulation 384/98 as amended, made under the Municipal Act,
2001, the prescribed amount for the purpose of Section 323(3) of the Municipal
Act is $75.00 per rated bed, per year.
AND WHEREAS
City Council has, in the past years, levied the maximum allowable amount on
these institutions;
AND WHEREAS
City Council considers it desirable to continue to levy the maximum allowable
amount on these institutions;
AND WHEREAS
the Minister of Health and Long-Term Care has determined the capacity of
provincially rated beds at:
(h)
Children’s
Hospital of Eastern Ontario has 230 beds;
(i)
Montfort Hospital
has 252 beds;
(j)
Royal Ottawa
Hospital has 179 beds;
(k)
Sisters of
Charity of Ottawa Hospital has 741 beds;
(l)
The Ottawa
Hospital has 1,689 beds and;
(m)
Queensway-Carleton
Hospital has 288 beds.
THEREFORE the Council of the City
of Ottawa enacts as follows:
1. There
will be levied upon the Children’s Hospital of Eastern Ontario for 2008 an
amount of $75.00 for each of the 230 rated beds in the hospital, the annual
amount levied being $17,250.00.
2. There
will be levied upon the Montfort Hospital for 2008 an amount of $75.00 for each
of the 252 rated beds in the hospital, the annual amount levied being
$18,900.00.
3. There
will be levied upon the Royal Ottawa Hospital for 2008 an amount of $75.00 for
each of the 179 rated beds in the hospital, the annual amount levied being
$13,425.00.
4.
There will be
levied upon the Sisters of Charity of Ottawa Hospital for 2008 an amount of
$75.00 for each of the 741 rated beds in the hospital, the annual amount levied
being $55,575.00.
5. There will be levied upon
The Ottawa Hospital for 2008 an amount of $75.00 for each of the 1,689 rated
beds in the hospital, the annual amount levied being $126,675.00.
6.
There will be
levied upon the Queensway-Carleton Hospital for 2008 an
amount of $75.00 for each of the 288 rated beds in the hospital, the annual
amount levied being $21,600.00.
7.
The amounts
levied under this by-law shall be paid to the City of Ottawa on or after July
1, 2008.
8.
The amounts
levied under this by-law are recovered in the same manner as municipal taxes
are recovered and are a special lien on the lands of the public hospitals and
provincial mental health facilities pursuant to the provisions of section 349
of the Municipal Act, 2001.
