That Council approve the application to vary setback provisions within Sign By-law 2005-439, to permit a ground sign within 0.3 metres to the front property, 0.5 metres to the side property line and 0.5 metres from a driveway, for the property at 199 Sussex Drive.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil d’approuver la demande visant à changer les dispositions concernant la marge de recul du Règlement sur les enseignes 2005-439 afin de permettre une enseigne au sol en-deçà de 0,3 mètre de la façade de la propriété, de 0,5 mètre de la limite de propriété latérale et de 0,5 mètre d’une voie d’accès, pour la propriété située au 199, promenade Sussex.

 

 

BACKGROUND

 

The applicant is seeking relief from setback provisions for a ground sign.  Under the by-law, there must be a setback of 1.0 metre to a front lot line, 1.5 metres to a side lot line and 1.0 metre to a driveway. 

 

If approved, the requested sign would have a setback of 0.3 metres to the front lot line, 0.5 metres to the side lot line and 0.5 metres away from the adjacent driveway.  The sign is intended to provide an identification marker at the ceremonial entrance of the Delegation of the Ismaili Imamat building that is now under construction at 199 Sussex Drive (see location map and site plan found in Documents 1 and 2).

 

DISCUSSION

 

The subject property is classified as a District 4 commercial use in the Sign By-law. Adjacent uses are an embassy to the west, the MacDonald Cartier bridge approaches to the east, parkland to the north and residential to the south.  At the proposed location, the sign would not be visible to adjacent residential uses as it would be screened by existing buildings.

 

The proposed sign face area will comply with the area provisions of the by-law with an area of 2.25 square metres (see Document 3).  This sign would be set in a landscaped planting strip that runs along the south side of the property.  The sign is to be finished in a material that will complement the architecture of the building.  Use of the driveway will be for ceremonial purposes rather than being the main access.  The proposed setbacks to lot lines and the adjacent ceremonial driveway will enable the ground sign to be centrally located within the planting area.

 

The circulation to the community and Ward Councillor generated no opposition to this application.  A representative of the National Capital Commission has also communicated to the Department that the agency has no objection to this application.

 

The Department is satisfied the application is in keeping with the intent of the Sign By-law and approval is recommended.

 

CONSULTATION

 

In response to the standard circulation to property owners, business and community groups and the Ward Councillor, no comments in opposition to the application were received.

DISPOSITION

 

City Clerk's Branch to notify the applicant, Lloyd Phillips and Associates, 1501 Carling Avenue, Suite 200, Ottawa, ON, K1Z 7M1 and the local Ward Councillor of Council's decision.  Building Code Services will process the sign permit resulting from the Council direction in accordance with Sign By-law 2005-439.
