WAIVER TO THE LICENSING BY-LAW and EXONÉRATION TEMPORAIRE DU RÈGLEMENT SUR

Committee Recommendations
1. That
Council approve a temporary waiver of the Licensing By-law (2002-189) and the
Designated Space Programme By-law (2007-478) to:
(a) authorize
the Chief License Inspector to establish temporary designated spaces for
vending on the sidewalk at suitable locations on O’Connor Street and Metcalfe
Street immediately to the south of the Sparks Street Mall Authority boundary
for the sale of tour tickets only;
(b) authorize
the Chief License Inspector to issue, subject to all terms and conditions of
the Licensing By-law 2002-189 (as amended) and its related Schedule 21,
Relating to Itinerant Sellers, temporary non-renewable annual Class “F” or “G”
business licenses to ticket sales operators;
(c) authorize
the Chief License Inspector to issue, subject to all by-law conditions of the
Designated Space Programme By-law 2007-478, temporary non-renewable designated
space permits related to the designated spaces referred to in Recommendation 1
in order to authorize the licensees and permit holders to vend at the temporary
designated spaces;
2. That
Community and Protective Services be directed to report back on a long-term
solution for the licensing and regulating of tour tickets sales and the
establishment of on-sidewalk designated vending spaces for tour ticket sales
kiosks within the downtown core.

Conseil approuve des exonérations temporaires au règlement municipal 2002-189
sur les permis d’entreprise et au règlement municipal 2007-478 sur le Programme
de places désignées pour :
(a) autoriser
l’inspecteur en chef des permis à établir des espaces désignées pour vente sur
trottoire à des endroits appropriées sur la rue O’Connor et la rue Metcalfe au
sud de la rue Sparks pour la vente de billets de visite seulement;
(b) autoriser
l’inspecteur en chef des permis à émettre, sujet à tout les termes et
conditions du règlement municipal 2002-189 sur les permis d’entreprise
(modifié), et l’annexe numero 21 relatif au aux vendeurs itinerants, des permis
d’entreprise temporaires non-renouvelable de categories “F’ ou “G” aux vendeurs
de billets de visite seulement;
(c) autoriser
l’inspecteur en chef des permis à émettre, sujet à tout les termes et
conditions du règlement municipal 2007-478 sur le Programme de places
désignées, des permis temporaries non-renouvelables pour les places désignées
sur trottoire mentionnées dans la recommendation 1(a) pour autoriser les
détenteurs de permis à vendre des billets de visite à partir des places
désignée sus-mentionnées;
2. Que les Services communautaires et de protection soient chargés de
proposer une solution à long terme en matière d’attribution de permis et de
réglementation de la vente de billets d’excursion, et en ce qui concerne
l’aménagement d’espaces désignés de vente sur le trottoir, pour des kiosques de
vente de billets d’excursion au centre-ville.

1. That
the Community and Protective Services Committee recommend that City Council
approve a temporary waiver of the Licensing By-law (2002-189) and the
Designated Space Programme By-law (2007-478) to:

The bus and guided tour industry forms an important part of Ottawa’s
travel industry and unfortunately the Sparks Street Mall Authority has
forbidden the tour operators from locating their ticket sales kiosks on the
Sparks Street Mall for the 2008 tourist season. As well the City of Ottawa’s current Licensing By-law does not
have a class of license to permit the sales of tour tickets at a kiosk located
within the public sidewalk of roadway.

Community and Protective Services
has no objections to the approval of the recommendation, provided that suitable designated
spaces can be established and that license and permit fees, and
regulations are consistent with other regulated on-sidewalk vending activities
in the downtown core.
There are no
financial implications associated with this report.
Upon Council approval, Community and Protective Services – By-Law will make the necessary arrangements to allow the kiosks and add to their work plan for the future.
