BACKGROUND
The property is approximately 53 hectares in size and is located within the Kanata South Business Park fronting on the north side of Fernbank Road and the west side of Eagleson Road (see Document 1). A hydro corridor forms the north boundary and the Monahan Drain crosses the site diagonally.
The residential community of Bridlewood is
located to the east (east of Eagleson Road), an existing employment area is
located to the north, and the Glen Cairn community is located further north.
The lands to the south (south of Fernbank Road), are draft approved for a mixed
use development and the residential component is presently under construction,
while the lands west of the subject site are used for agricultural purposes.
A plan of subdivision was draft approved for this site in November 2006. Prior to obtaining approval of the draft plan of subdivision, Council adopted a Zoning By-law amendment for the subject lands on July 13, 2005. The subject property was rezoned from M1A-3 (Light Industrial Three Zone), M1D (Light Industrial Automotive Zone), HZD (Hazard Zone) and OS1 (Open Space One Zone) to R3A-4 (Residential Three Special Exception Four Zone), OS1 (Open Space One Zone), M1A-8 (Light Industrial Select Eight Zone) and CG-7 (General Commercial Exception Zone Seven), to permit the development of a mixed use community with a variety of land uses and housing types. As part of the servicing for the lands the proponent will be installing Fibre to the Home (FTTH) for the entire development.
An application to revise the November 2006 draft approved plan was submitted in early 2007, which changed the location of the park, and added public streets to the northeast quadrant of the plan. These changes in layout required a zoning amendment (D02-02-06-0119) for the subject property, which was adopted by Council on March 28, 2007.
An application to further revise
the subdivision layout was submitted in late 2007. For technical reasons, both the Monahan Drain that
runs through the subdivision lands and the proposed park need to be relocated.
The purpose of the subject Zoning By-law amendment is to implement the latest
revised draft plan and permit the relocation of the Monahan Drain to the north
and to locate the proposed park directly adjacent to the Monahan Drain. As
a result of the Drain and park relocation, the majority of street patterns and
block locations had to be reconfigured. The high density residential blocks
have been relocated central to the subdivision fronting onto Akerson Road. The subject application also
proposes a number of minor changes in land uses to reflect these changes in the
draft plan of subdivision.
The current approved R3A-4 zoning permits semi-detached dwellings, multiple attached dwellings (townhomes and stacked townhome units) and apartment dwellings. Currently lands identified as the Monahan Drain and a community park are zoned Open SpaceType One (OS1). This zone permits a conservation use, park and public use. The CG-7 zone applies to lands fronting on both sides of Cope Drive and is intended to accommodate live/work units similar in exterior design to those found along Centrepointe Drive in the former City of Nepean.
The proposed Zoning By-law amendment, will
include a long strip of land just north of the existing Monahan Drain to be
rezoned from the M1A-8, R3A-4 and CG-7 Zones to OS1, to accommodate the
relocation of the Drain and the newly proposed park location. The existing strip
of OS1 land that currently contains the Drain is proposed to be rezoned to both
the R3A-4 and CG-7 zones to accommodate both residential and commercial
development.
The applicant is requesting to rezone parts of the land to reflect the proposed revisions to the draft approved plan of subdivision; to change the zoning for parts of 5271 Fernbank Road from Residential Type Three (R3A-4 Zone), Residential Type Three (R3A-5Zone), General Commercial (CG-7 Zone) and Open Space (OS1 Zone) to Residential Type Three (R3A-4 Zone), General Commercial (CG-7 Zone), Light Industrial (MIA-8 Zone) and Open Space (OS1 Zone) as shown in Document 1 and 2 attached.
The rezoning application is in accordance with the applicable Official Plan policies and is required to reflect the approved draft plan of subdivision for the subject lands.
The subject lands are designated Enterprise Area. The Enterprise Area designation identifies areas where the primary land uses are commercial, office and industrial.
The designation does however, permit residential uses provided that the residential component meets certain criteria and does not limit the ability of the area to achieve its original employment target.
The plan of subdivision and the implementing Zoning By-law were examined pursuant to the policies of the Enterprise Area and were found to be in conformity. In addition to the employment block, opportunities for employment are provided in a variety of residential unit types, all connected with fibre optic cable to allow for home based employment. The introduction of “Fibre to the Home” in this subdivision will contribute to the realization of the Council approved “Broadband Plan” which recognizes the importance of broadband services to achieve a “well-planned and serviced municipality”. The subject change in zoning represents a minor change to the original Zoning By-law amendment and implements the proposed revisions to the draft approved subdivision plan.
Staff are recommending that the
Zoning By-law amendment be approved. The amendment conforms with the policies
of the Enterprise Area designation, and will contribute to the realization of the Council approved “Broadband
Plan”.
New Comprehensive Zoning By-law
It is intended that the draft New Comprehensive
Zoning By-law will be passed by City Council on June 25, 2008. In anticipation
of the new By-law’s enactment, the following required changes to the By-law
have also been identified so that the relevant zoning provisions can be
implemented as soon as possible after the new by-law has been passed:

CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-law amendment
applications.
