2.   Approve an amendment to the new Comprehensive Zoning By-law to change the zoning of 6198 First Line Road from “RU” and “RG” to RU-1 and 6204 First Line Road from “RG” to “RG [xxxr]” as shown in Document 1 and detailed in Document 2.

That the Agriculture and Rural Affairs Committee recommend Council approve an amendment to the former Rideau Township Zoning By-law to change the zoning of 6198 and 6204 First Line Road from MR-3 to R and to amend the MR-3 zone provisions as shown in Document 1 and detailed in Document 2.

Que le Comité de l'agriculture et des questions rurales recommande au Conseil d'approuver une modification au Règlement de zonage de l'ancien canton de Rideau, de manière à faire passer le zonage des 6198 et 6204, chemin First Line de MR-3 à R, et de modifier les dispositions du zonage MR-3 tel qu'illustré dans le Document 1 et exposé en détail dans le Document 2.

 

 

BACKGROUND

 

The applicant owns 6198 and 6204 First Line Road which are currently developed sites, 6198 for a residence and 6204 as an automobile body shop.  The lots are located north of Phelan Road East and west of First Line Road.  Lands to the north are residential in nature. Lands to the immediate east, west and south are used for agricultural purposes.

 

The applicant applied to the Committee of Adjustment to add 0.455 hectares from a rural industrial parcel (existing body shop), 6204 First Line Road, to the residential property at 6198 First Line Road.  The rezoning is required to fulfill a condition of consent related to a lot line adjustment approved by the Committee of Adjustment in November of 2007.

 

 

DISCUSSION

 

Official Plan 

 

The parcel is designated General Rural within the Official Plan. The policies permit limited rural commercial uses. The current uses exist and are deemed to conform to the Official Plan. 

 

Details of Proposed Zoning

 

The purpose of the application is to rezone land to be conveyed from 6204 First Line Road, currently zoned MR-3 (Rural Industrial - exception 3), to 6198 First Line Road currently zoned R (Residential). 

 

The MR-3 zone requires a minimum frontage of 60 metres.  The final lot configuration for 6204 First Line Road will be 53.2 metres. The zoning therefore will recognize lack of frontage on 6204 First Line Road and set the minimum lot frontage at 53 metres.

 

The owner has also requested recognition in the Zoning By-law for the ability to display vehicles for sale to a maximum of four cars accessory to the body shop on 6204 First Line Road zoned MR-3.  The accessory vehicle sales and display proposed is limited to ensure the use is accessory to the existing use.

 

Concurrent Application 

 

Lot Line Adjustment Application conditionally approved November 2007, added lands from an existing industrial lot to an existing residential lot.  No new lots were created as a result of the lot line adjustment.

 

Summary

 

The rezoning addresses the zoning issues arising from approval of the consent to adjust the lot lines between the two properties, and will permit the consent granted by the Committee of Adjustment to be finalized.

 

The rezoning to add and restrict accessory vehicles sales is supported as an accessory use to the existing automobile body shop in support of the local rural economy.

 

 

RURAL IMPLICATIONS

 

The zoning proposal supports rural development and allows for uses accessory to an existing rural industrial use.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

WHEREAS the Report Recommendation of Planning and Environment Committee Report ACS2008-PTE-PLA-0065 did not address amendments to the new Comprehensive Zoning By-law;
 

AND WHEREAS revisions to the said Report Recommendation are necessary to provide the appropriate authority to pass the required amendments to the new Comprehensive Zoning By-law;

 

THEREFORE BE IT RESOLVED THAT Committee amend the recommendation in the report by adding the following Report Recommendation:

 

That the Agriculture and Rural Affairs Committee recommend Council approve an amendment to the new Comprehensive Zoning By-law to change the zoning of 6198 First Line Road from “RU” and “RG” to RU-1 and 6204 First Line Road from “RG” to “RG [xxxr]” as shown in Document 1 and detailed in Document 2 attached hereto.
