That Council
approve:
1. That
the permit holders within the construction limits during the Preston Street
Reconstruction Project be permitted to operate patios on the right-of-way (ROW)
at no charge, where and when the approved boundaries of their patio are
available and as permitted by the contractor; and
2. That
the permit holders on Preston Street outside of the construction limits be
offered the opportunity to open their patios while being charged the lower
'Boulevard' as opposed to the 'Sidewalk' rate.

That the Transportation Committee

BACKGROUND
The following motion is being placed on the agenda for the consideration of the Transportation Committee as requested by Councillor Diane Holmes:
Whereas the Preston Street Reconstruction project is in the detailed
design stage with construction commencing in the spring of 2008;
And whereas there is a strong interest in recognizing and building on the
vibrant pedestrian atmosphere;
And whereas roadway construction is a very difficult time for businesses
and Preston Street is expected to take 3 years to complete;
And whereas patios will maintain pedestrian activity on the street;
And whereas only 6 restaurants within the Preston Street BIA currently
have patios operating on the ROW (357 Preston St. pending);
Therefore be it resolved that the permit holders within the construction
limits be permitted to operate patios on the ROW at no charge, where and when
the approved boundaries of their patio are available and as permitted by the
contractor;
Further be it resolved that the permit holders on Preston Street, but outside of the construction limits, be offered the opportunity to open their patios while being charged the lower 'Boulevard' as opposed to the 'Sidewalk' rate.
CONSULTATION
This item will be advertised in the local dailies as part of the Public Meeting Advertisement on Friday preceding the Transportation Committee Meeting.
The Preston BIA supports these recommendations.
Public Works and Services Comments:
PWS staff do not have delegated authority to waive temporary outdoor
patio encroachment fees. Non-refundable
fees are calculated for the number of days from the permit start date to
September 30, in accordance with Section 63(2) of the City of Ottawa
Encroachment By-law 2003-447.
Staff
have no concern with the proposal for the reduction in the permit encroachment
rate within the active construction zone along Preston Street, but we do have
concern with respect to the part of the proposal that relates to outside the
active construction zone. This sets a
precedent for this project, and others within the City, and has financial
impacts over an undetermined time frame.
FINANCIAL IMPLICATIONS
Public Works and Services, Traffic and Parking Operations Branch, has advised the waiving and/or reduction in permit encroachment rates as per the report’s recommendation would have a total estimated impact on 2008 revenue in the amount of $15,102.36 based on the establishments that normally are issued permits in the affected construction area.
There is one location that exists outside of the construction area. If this location is removed from consideration (as per staff’s concerns), the revenue impact becomes $12,132.12.
