COMMITTEE RECOMMENDATION

 

That Council waive the license and permit fees related to the 2008/2009 vending activity at Designated Space No. 30, and that the license and associated designated space permit expire May 14, 2009, with no possibility for extension after this date if the license and permit are not renewed in accordance with the respective by-laws.

That the Community and Protective Services Committee recommend that Council waive the license and permit fees related to the 2008/2009 vending activity at Designated Space No. 30, and that the license and associated designated space permit expire May 14, 2009, with no possibility for extension after this date if the license and permit are not renewed in accordance with the respective by-laws

Que le Comité des services communautaires et de protection recommande au Conseil de renoncer aux frais de permis et de licence liés aux activités de vente de trottoir pour 2008-2009 en ce qui concerne l’emplacement désigné no 30, et, que la licence et le permis d’emplacement désigné connexe expirent le 14 mai 2009, sans possibilité de prolongement au-delà de cette date si la licence et le permis ne sont pas renouvelés conformément aux règlements respectifs.

 

 

BACKGROUND

 

Councillor Holmes presented the following Notice of Motion at the Community and Protective Services Committee meeting on 17 April 2008.  Pursuant to Section 84 (3) of the Procedure By-law, the Committee added the item for consideration:

 

WHEREAS a long time refreshment vendor has requested that the City grant an additional one (1) year extension on his right of license and permit renewal, the waiving of the related license and permit fees, and permission to leave his designated space vacant during the 2008/2009 vending season;

 

AND WHEREAS Council granted a similar request for license reference No. 018000 and permit fee for Space No. 30, reference No. 715734 and waived fees for a one-year period commencing May 15, 2007 to May 14, 2008;

 

AND WHEREAS the vendor has operated at the same location for over 20 years with no incidents of non-compliance with the conditions of his license or permit, and wishes to retain his right to renew his permit and license in May 2009;

 

AND WHEREAS the City’s Designated Space Programme By-law 2007-478 and Licensing By-law Number 2002-189, as amended, do not provide for the waiving of fees and the by-laws provide for the designated space permit and refreshment license to become void if they are not renewed year to year;

 

AND WHEREAS staff has no objections to the extension for one additional year, but that no additional extensions be permitted after May 14, 2009;

 

THEREFORE BE IT RESOLVED that the Community and Protective Services Committee recommend that Council waive the license and permit fees related to the 2008/2009 vending activity at Designated Space No. 30, and that the license and associated designated space permit expire May 14, 2009, with no possibility for extension after this date if the license and permit are not renewed in accordance with the respective by-laws.

 

 

DISCUSSION

 

Andrew Lay, a food vendor licensed and authorized to vend from the sidewalk, has requested that the City grant an additional one (1) year extension on his right of license and permit renewal, the waiving of the related license and permit fees, and permission to leave his designated space vacant during the 2008/2009 vending season.  Council granted a similar request in 2007 (ACS2007-CPS-BYL-0013 to Council, 23 May 2007 refers) and waived fees for a one-year period commencing May 15, 2007 to May 14, 2008.

 

Mr. Lay has operated at the same location for over 20 years with no incidents of non-compliance with the conditions of his licence or permit, and wishes to retain his right to renew his permit and license in May 2009.

 

 

CONSULTATION

 

The ward Councillor is aware of and supportive of the request.

 

Community and Protective Services – By-law Services

 

Staff has no objection to allowing the vendor in question to leave his designated space vacant for one year nor would staff object to holding his refreshment vehicle license for the year without requiring that he pay either of the related fees.  However staff recommends that no additional extensions be permitted after May 14, 2009.

 

 

FINANCIAL IMPLICATIONS

 

Approval of the recommendation in this report would result in a loss of revenues in the amount of $2,050 from licensing and permit fees.
