Que le Comité des services organisationnels et du développement économique recommande au Conseil d’approuver l’entente sur l’accès aux routes municipales décrite dans le présent rapport, qui a été conclue entre la Ville d’Ottawa et la société Vidéotron Ltée.

 

 

BACKGROUND

 

Telecommunication and utility companies have a statutory right to use municipal streets, subject to the consent of the municipality.  The process, terms and conditions for granting municipal consent are embodied in a legal document called a Municipal Access Agreement (MAA).


 

At its meeting of 28 March 2001, City Council confirmed policies of the former Region of Ottawa-Carleton and the former City of Ottawa and approved a policy authorizing the Department to issue municipal consents and road cut permits only to telecommunications companies that have an MAA in place with the City of Ottawa.

 

Vidéotron Ltée has been operating in the City of Ottawa under two MAAs, one with the former City of Ottawa dated 17 January 2001 and the other with the former Region of Ottawa-Carleton dated 19 September 2000.

 

 

DISCUSSION

 

Ongoing negotiations with Vidéotron has resulted in an agreement to enter into a new single MAA for the entire City.

 

This proposed MAA is for a non-exclusive five-year period (with renewal options) which, sets out the terms and conditions by which Vidéotron shall enter on to, work, maintain, repair and reinstate City streets.  The MAA provides, in part, the following:

 

1.      City approval of the location of the installation of any plant under terms and conditions as identified by the Deputy City Manager of Public Works and Services and in accordance with all City by-laws including the payment of all permit fees;

 

2.      The manner in which Vidéotron will carry out work within the City's streets including the obligation on Vidéotron to repair and reinstate the City's streets, provide locating service and emergency contacts;

 

3.      The conditions under which Vidéotron must provide the relocation or adjustment of plant in response to a request from the City;

 

4.      A requirement that Vidéotron will maintain its membership in the Ottawa Utilities Coordinating Committee including the identification of future works for coordination with other Utilities and the City and the provision of as-built drawing information for incorporation into the Central Registry.

 

 

CONSULTATION

 

There has been been no public consultation as this is a commercial agreement between the City and Vidéotron.


FINANCIAL IMPLICATIONS

 

As part of the MAA, Vidéotron has agreed to pay the City an annual amount of $5,000 to compensate the City for the costs incurred by the City arising from Vidéotron's installation of its equipment and its presence in the City’s streets.

 

 

DISPOSITION

 

Legal Services Branch to finalize and arrange for the execution of the Municipal Access Agreement betweeen the City of Ottawa and Vidéotron Ltée.
