BACKGROUND

 

Delcan Corporation, on behalf of the property developers, Canadian Tire Real Estate Limited, has submitted an application to increase the sign area limitation of the Sign By-law, to permit the installation of an oversized pylon ground signs for the purpose of identifying the Canadian Tire complex and other retail businesses to be located on the subject property. 

The sign will be installed perpendicular to the street adjacent to the southerly vehicular entrance on Clyde Avenue (reference Documents 1 and 2).

 

An earlier report was submitted to the Planning and Environment Committee on January 23, 2006 recommending refusal for two oversized ground signs, one adjacent to Carling Avenue and the second adjacent Clyde Avenue.  On February 14, 2007, City Council referred the item back to the Planning and Environment Committee to provide the time to consider other alternatives.  The sign adjacent to Carling Avenue has since received approval with a waiver to the Encroachment By-law.  As such, this application has been modified for consideration of the sign adjacent to Clyde Avenue only. 

 

DISCUSSION

 

The property is located on the southeast corner of Carling and Clyde Avenues, zoned CD3 F(1.0) H(22) forming part of a Linear Commercial Zone classified under the Sign By-law as District 4.  Area land use includes local retail commercial businesses adjacent to Carling Avenue, primarily serving the neighbourhood.  Commercial and light industrial uses are located south of the property facing Clyde Avenue in close proximity to the Queensway.  Residential development is located to the north of the businesses on Carling Avenue.

 

Sign regulations are established in respect of area land use as permitted under the Zoning By-law and Official Plan guidelines.  The zoning for the subject property permits district commercial development intended to be at a scale compatible with the character of the local retail commercial uses.  At this location, the By-law permits one identification ground sign per street frontage with a maximum sign area of 14 square metres and a height of 8.0 metres.  The proposed sign at 20 square metres would exceed the area limitation by 44 per cent.

 

In support of requests to vary the By-law, the applicant must demonstrate circumstances that warrant special consideration, for example; where a sign is significantly set back from the street, where there is a permanent obstruction obscuring the view of the sign or if there are multiple tenants that require identification at a scale sufficiently clear to passing motorists.

 

The applicant suggests that the increased scale is necessary, in that the sign proposed for the southwest corner of the property adjacent to Clyde Avenue is significantly set back from Carling Avenue and to avoid entering the complex at the mid-point egress, the larger sign is required.  Further, that the project should be classified a shopping centre, thereby qualifying the project under Section 107 of the By-law allowing an additional 6.0 square metres of sign area.

 

The Sign By-law does allow additional signage for designated shopping centre projects.  However, the intent of the By-law and the consistent application of the shopping centre provision dictates that the additional area is intended for the larger complexes, typically zoned CS in excess of 250 000 gross lease-able area e.g. Bayshore, Carlingwood or St. Laurent shopping centre, rather than neighbourhood complexes.

 


The Department does support the rationale that the sign is remote from Carling Avenue and, for clarity to encourage patrons to enter at the south end entrance of the site, an increase in the maximum permitted sign area from 14 to 20 square metres is considered appropriate. 

To reduce the impact of the increased scale, the applicant has agreed to reduce the height originally proposed for the sign from 9.14 metres to 8.0 metres.  As such, the Department is recommending approval. 

 

CONSULTATION

 

In response to the circulation to area property owners/occupants (within 60 metres) and Community/Business groups, four responses were received.  Of note, is that the original application was to approve two ground signs, one adjacent to Carling Avenue and one adjacent to Clyde Avenue.  In response, one respondent was in support and three opposed to the application.  No comments in support were provided.  Concerns expressed related to ensuring visibility of adjacent businesses signage on Carling Avenue.

 

The responses summarized above relate to the sign adjacent to Carling Avenue and there we no submissions received in opposition to the sign on Clyde Avenue.

 

The Ward Councillor is aware of the issue.
