That Council:

2. suspend the requirement for a public
consultation process due to the administrative nature of the report.

REPORT RECOMMENDATIONS
That the Community and Protective Services Committee recommend
that Council:
1. approve amending Licensing By-law 2002-189, Schedule 20
relating to Body-rub Parlours, to remove 1916 Merivale Road from the list of
approved Body-rub Parlour locations;

The report
recommends that Licensing By-law 2002-189, Schedule 20 relating to Body-rub Parlours be amended to remove 1916
Merivale Road from the list of locations from which the operation of body-rub
parlours is permitted. On September 17,
2007, the License
Committee rendered a decision to refuse a pending application for a body-rub
parlour at 1916
Merivale Road. This decision prompted
the request for removal of this address as a potential location for a Body-rub Parlour.
RÉSUMÉ
Selon le rapport, il est recommandé de modifier l’annexe 20 du
Règlement no 2002-189 sur les permis concernant les salons de massage,
afin de retirer de la liste des établissements où il est autorisé de pratiquer
des massages le salon situé au 1916, chemin Merivale.
Le 17 septembre 2007, le Comité des permis a
rendu sa décision de refuser la demande en attente d’un permis de salon de
massage au 1916, chemin Merivale. Cette décision est à l’origine de la demande
de retrait de cette adresse de ladite liste.
BACKGROUND
The Ontario Municipal Act, 2006, PART IV, entitled LICENCES authorizes a municipality to license, regulate and govern businesses carried on within the municipality. Section 151 (1)(a) of the Act further expands this authority to allow the municipality to define the area of the municipality in which adult entertainment establishments may or may not operate and to limit the number of licenses granted in any defined area in which these are permitted. Section 151(1)(b) of the Act defines body-rub parlours as adult entertainment establishments.
DISCUSSION
On April 19, 2007, Committee approved amendments to limit the number of body-rub parlours under Schedule 20 of Licensing By-law 2002-189. Council also approved a Motion stating that any new owner who applies for a body-rub parlour license must comply with a new location restriction of being 1,000 metres from a school, place of worship, daycare, public library, community centre, public park or a property zoned residential. Approval of that Motion meant that some of the existing body-rub parlours would not be permitted under this new requirement. Therefore an address list was created whereby these existing parlours would be permitted to stay open until they decided to close, at which time a new owner would have to comply with the new location restriction.
Thirty (30) body-rub parlours that currently have an active license were placed on the list of approved locations and two (2) pending applications that were received prior to the writing of the amendment were also placed on this list. One of these pending applications was for 1916 Merivale Road.
The license application for 1916 Merivale Road prompted an investigation that revealed there were reasonable grounds to believe that the carrying on of the business may be adverse to the public interest. In accordance with the by-law, the application was rejected. The applicant appealed the decision and a Hearing at the License Committee was scheduled for September 17, 2007. The Committee heard the appeal and based on evidence, unanimously upheld the recommendation of the Chief License Inspector to refuse the issuance of a body-rub parlour license for 1916 Merivale Road. If a new owner were to apply at this location, it would not be permitted under the new location restrictions. Therefore staff recommends that 1916 Merivale Road be removed from the list of approved locations in the Body-rub Parlour schedule of the licensing by-law.
A public consultation is required for all licensing by-laws. In this case however, the requirement was suspended as the address being removed was only originally put in the by-law in consideration of the pending application for that address. As the application was not approved and as there was not a previous Body rub Parlour at this address, there is no impact to the public on its removal from the by-law.
