That the recommend Council approve an amendment to the former Osgoode Zoning By-law to change the zoning of the southeast part of 2368 9th Line Road from Rural (RU) to Country Estate (CE) as shown in Document 1.

domaine de campagne (CE), comme il est indiqué dans le document 1.
BACKGROUND
This application affects a portion of a lot located at 2368 9th Line Road. The subject land is located southeast of the intersection of Pana Road and 9th Line Road. The site is land-locked, measuring approximately 114.87 metres by 78.20 metres and contains an area of 0.84 hectares. The owners of 2368 9th Line Road would like to convey the vacant parcel to the residential landowner abutting on the southeast. This Zoning By-law amendment application has been made to fulfill a severance condition relating to a lot line adjustment.
With this Zoning By-law amendment, the abutting landowner to the southeast will consolidate this site with 2398 9th Line Road and extend the backyard of the current Country Estate lot at that location.
According to the Official Plan, the land being considered for rezoning is “General Rural Area”. The General Rural Area contains a variety of land uses, such as farms, rural housing, wood lots and forests, small industries, golf courses, and in many places, small clusters of residential and commercial development. The intent of this designation is to accommodate a variety of land uses that are appropriate for a rural location where such development will not preclude continued agricultural uses.
According to the Osgoode Zoning By-law 2003-230, the site is zoned Rural (RU). This zoning permits a single detached dwelling or agricultural and forestry use together with residential accommodation for the owner or resident staff, or both. The zone also permits an animal kennel and other uses. The subject land is currently vacant and abuts the Country Estate Zone (CE).
The applicant’s request to change the rural zone to a country estate zone so as to align the back of 2398 9th Line Road’s back yard with the Zoning By-law’s delineation of the zone is considered appropriate for the site.
The additional CE land will allow the landowner of 2398 9th Line Road to maintain an undeveloped buffer of trees and bush along the back of his lands.
All technical issues related to environmental, noise, traffic and servicing concerns do not apply in this rezoning application as the intent of the landowner of 2398 9th Line Road is to keep the lands undeveloped (vacant).
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.

This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-law amendment
applications.
