That Council approve the initiation of the expropriation process for all property requirements associated with the construction of the Pagé Road Stormwater Management Ponds and East Urban Community Feedermain, if necessary, as set out in this report.

BACKGROUND

 

City Council, by its approval of the 2002 Capital budget, approved funding for the design and construction of the Pagé Road Stormwater Management Ponds and East Urban Community Feedermain.  The timing of the project is dependant on the pace of development in the East Urban Community, with actual construction costs to be front-ended by the developers.  Development planned for the next year has necessitated construction of the stormwater management ponds within the same time period. The purpose of this report is to seek Council approval for staff to initiate expropriation, if necessary. Negotiations with property owners will continue until all options are exhausted.

 

 

DISCUSSION

 

The Pagé Road Stormwater Management Ponds requires land from numerous property owners adjacent to Pagé Road at the Hydro One Networks Utility corridor.  Part of the East Urban Community Feedermain will be constructed with the Stormwater Management Ponds and temporary easements will be required for construction purposes. 

 

The 2002 Capital Budget that approved the project, did not include specific authorization for staff to initiate expropration for all and any property rights required to facilitate the said construction.  In accordance with section 4 of the“Expropriations Act” Council, the expropriating authority, must approve and direct staff to proceed with the acquisition of lands required to facilitate the project, including expropriation, if necessary.  Notwithstanding the forgoing and pursuant to the direction of Public Works and Services (PWS), Real Estate Services contacted affected property owners with a view to negotiating the acquisition of the requirements.

 

While staff were able to negotiate agreements for purchase of the property requirements from some property owners, the City has been unable to conclude agreements with all owners.

 

In order to secure the required property in a timely manner and proceed with the construction of the Stormwater Management Ponds and Feedermain, it is required that the City proceed with the expropriation required to facilitate the construction of the Stormwater Ponds and Feedermain projects.  Upon Council approval of this report, as the expropriating authority, staff can then proceed with the expropriation procedures by providing the statutory notices to the owners together with publishing the required notices in the newspapers having general circulation in the locality in which the lands are located.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The Stormwater Management Ponds have been approved by the Ontario Ministry of Environment and the detailed design will be vetted by the Rideau Valley Conversation Authority. 

 

 

CONSULTATION

 

Public consultation for the project was part of the Municipal Class Environmental Assessment process and included open houses and notices starting with the area Master Drainage Plan in 1992 up to the City’s Community Design Plan in 2005. The Ward Councillor has been made aware of the proposed expropriations and has voiced no objections to staff’s recommendation.

 

 

FINANCIAL IMPLICATIONS

 

Failure to acquire the needed property in a timely manner will result in delay of the construction of the Stormwater Management Pond and Feedermain, which may negatively impact the expansion of the East Urban community.

DISPOSITION

 

Following approval, the Real Estate Services Division of the Real Property Asset Management Branch through City and external Legal Counsel will commence expropriation proceedings.  Surveys and Mapping are to prepare and register reference plans and plans of expropriation as required.
