Lot 33, Concession 1, O.S., geographic Township of Cumberland being part of
Part 2, Plan 50R-6091, in the City of Ottawa, as surplus to the City’s needs;
and
2. Approve the sale of the land detailed
in Recommendation 1, subject to a grading easement in favour of the City of
Ottawa indicated as Parcel B on the attached Annex “A” sketch and any other
easements that may be required, to Bellevue Mobile & Motor Homes Limited,
for the amount of $9,600 plus GST, pursuant to an Agreement of Purchase and
Sale that has been received.

The subject property is a vacant parcel of land legally described as Part of Lot 33, Concession 1, O.S., geographic Township of Cumberland. The property is rectangular in shape and contains a total area of 457.8 square metres (4,927.9 square feet) subject to final survey and is located on the north side of St. Joseph Boulevard, east of Tenth Line Road.
The Region of Ottawa-Carleton acquired the property in
1994 for the future widening and reconstruction of Regional Road 34 (St. Joseph
Boulevard). The property was improved
with a single-family residence that was demolished in 2002 because of the
deteriorating condition of the building.
The property is not viable as a building lot and the abutting property owner, Bellevue Mobile & Motor Homes Limited, approached the City expressing interest in purchasing the property to allow access to St. Joseph Boulevard from its abutting property to the north.
The property is no longer required by the City for widening of St. Joseph Boulevard as it is anticipated that any future reconstruction would occur within the existing right-of-way. The Department of Public Works and Services has requested that the City retain a grading easement over a portion of the property shown as Parcel B on the attached sketch. The City will also be retaining a reserve along the St. Joseph frontage of this property to ensure that no vehicular or servicing access is permitted until an engineering traffic and site servicing report is submitted in support of a site plan application that demonstrates that there are no safety or operational issues with such an access.
DISCUSSION
An agreement has been reached with Bellevue Mobile & Motor Homes Limited to purchase the subject City property.
The zoning of the City property is CH – Commercial Highway former Cumberland Zoning By-law 1-84. The proposed zoning in the new comprehensive zoning by-law is GM13 H (20) – General Mixed-Use Zone. The new zoning will allow residential, commercial and institutional uses. The intended use of the subject property is to consolidate the lands being purchased with the abutting lands to the north owned by the purchaser, which currently has the same zoning, for future development. Any future development on the lands being acquired as well as the purchaser’s adjoining lands will be subject to site plan approval.
The sale price of the property is $9,600 and is supported by an independent appraisal. The purchaser has agreed to reimburse the City for appraisal costs in the amount of $3,500.
ENVIRONMENTAL IMPLICATIONS
The Environmental Sustainability Division of
Planning, Transit & the Environment Department has confirmed that there are
no natural environmental implications with the sale of the property.
The Housing First Policy, approved by Council on 13
July 2005, establishes priority consideration to the Housing Branch in the
identification of potentially surplus City-owned property to be used in
achieving the City’s affordable housing program targets. The policy also requires that the Official
Plan target of 25% affordable housing, be met on any City-owned property sold
for residential development. Where
viable residential properties are disposed of without a condition requiring an
affordable housing component, 25% of the proceeds from the sale are to be
credited to a housing fund to be used for the development of affordable housing
elsewhere in the City.
The subject property is non-viable and zoned CH – Commercial Highway. The property does not meet the affordable housing criteria outlined in the Housing First Policy.
CONSULTATION
In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning, Transit and the Environment, to determine if the property should be retained for a City mandated program. The Environmental Management Group of the Planning, Transit and the Environment Department was consulted with respect to the Green Space Master Plan and their comments are indicated under the Environmental Implications section of this report. No Department expressed interest in the property other than the requirement for the retention of a grading easement by Public Works and Services.
The utility companies were also circulated and there is no plant requiring easement protection in the parcel being sold.

No concerns were expressed with respect to the sale of the subject property.
The ward Councillor is aware of the sale of this property to the abutting owner and supports the sale.
FINANCIAL IMPLICATIONS
This transaction represents revenue of $9,600 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.

Attached as Annex "A" is a sketch showing the surplus property.
DISPOSITION
Following Council’s approval, Real Property Asset Management and Legal Services Branches will finalize the transaction.
