That Council approve that the licence fee for licence reference No.
018000 and permit fee for Space No. 30, reference No.715734 be waived for a one
year period commencing May 14, 2007 and that the Chief License Inspector hold
the permit, the designated space and licence in abeyance for this vendor for
this one year period after which time if the vendor has not paid the requisite
fees, the designated space is to deemed to be vacant and the licence void in
accordance with the related regulations.

REPORT RECOMMENDATION
That Community and Protective
Services Committee recommend to Council that the licence fee for licence
reference No. 018000 and permit fee for Space No. 30, reference No.715734 be

BACKGROUND
The City's Designated Space Programme and Licensing By-law Number L6-2000 do not provide for the waiving of fees, and the by-laws provide for the permit and license to become void if they are not renewed year to year.
Mr. Lay, a food vendor licensed and authorized to vend from the sidewalk, has approached the City for permission to leave his space vacant during the 2007 vending season while he is out of the country and to waive the 2007 permit and license fees.
He has operated at the same location for over 20 years with no incidents of non-compliance with the conditions of his licence or permit, and wishes to retain his right to renew his permit and license in May 2008.
Following the one year time period, should the vendor not have paid the requisite fees, the designated space is to be deemed to be vacant and the license void in accordance with the related regulations.
Due to the time restrictions of the permit renewal process, this item is scheduled to rise to Council on May 23, 2007.
CONSULTATION
Staff has no objection to allowing the vendor in question to leave his designated space vacant for one year nor would staff object to holding his refreshment vehicle license for the year without requiring that he pay either of the related fees.
The ward Councillor is aware of the request.
The Bank Street Business Improvement Association and the Sparks Street Mall Management Board have been contacted to advise of this request.
FINANCIAL IMPLICATIONS
The recommendation of this report would incur lost revenues in the amount of $2100 from licensing and permit fees.
DISPOSITION
Community and Protective Services Staff will comply with the direction of Committee and Council.
