- plaine inondable) à RU-53 (zone
rurale – exception) et RU-53 FP (zone rurale – exception, plaine inondable),
tel qu’il est indiqué dans le document 1 et expliqué en détail dans le document
2.
BACKGROUND
The parcel to be rezoned is 19 hectares in area,
located on the north side of Craig Side Road, west of Carp Road, and east of
the Carp River. The Village of Carp and
the Diefenbunker property lay south of the subject lands. The parcel to be rezoned is farm field used
for cash crop and hay production and slopes to the Carp River forming the
western property boundary.
The applicants applied for, and received, conditional consent from the Committee of Adjustment to sever the dwelling and accessory detached garage known as 2241 Craig Side Road. The dwelling has been made surplus through farm consolidation on a 1.39-hectare parcel. In accordance with the requirements of the Provincial Policy Statement, parcels remnant of such applications are required to prohibit the construction of future dwellings on the vacant farmland. Consent to sever the dwelling is conditional on this rezoning.
The current zoning is RU (Rural).
The
lands will be placed in an RU-exception 53 (RU-53) zone and RU-exception 53
flood plain (RU-53 (FP)) to prohibit residential dwellings on the lot.
The subject land is designated Agricultural
Resource in the Official Plan.
Policy 3.7.3.14 provides where an application to sever a surplus dwelling is made, for lands that
abut the main farm or not, the City will require the vacant agricultural parcel
so created be rezoned to prohibit any residential use.
The
proposed zoning is to fulfill a condition of consent granted by the Committee
of Adjustment to sever a surplus dwelling to conform to the above-noted
policies.
The
zoning continues to protect the Flood Plain abutting the Carp River.
The site is impacted by the flood plain along the Carp River on the western property boundary. The flood plain zone will remain in place.
The zoning supports the agricultural economy, permitting a condition of the Committee of Adjustment to be finalized and allows severance of a dwelling made surplus through farm consolidation.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-law amendment
applications.
