1.         Declare a parcel of vacant land, shown hatched on Annex “A” attached, containing an area of 7,651 m2, described as part of Lot 16, Concession 4 (Rideau Front), geographic Township of Nepean, now City of Ottawa, subject to final survey and subject to the road being stopped up and closed by by-law, as surplus to the City’s needs;

 

2.         Approve the sale of the land outlined in Recommendation 1, subject to any easements that may be required, to DCR Phoenix Development Corp. for $142,000.00 plus GST, pursuant to an Agreement of Purchase and Sale that has been received.

BACKGROUND

 

Temporary Road is a travelled, public roadway located between Cedarview Road and Strandherd Drive, in the southwest quadrant of the Barrhaven Community in the former City of Nepean.  It is legally described as Part of Lot 16, Concession 4 (Rideau Front), geographic Township of Nepean, now City of Ottawa, and is shown hatched on the attached Annex “A”.

 

Temporary Road is situated between an 8.4 ha parcel of vacant land and an 8.9 ha parcel of vacant land which are both owned by DCR / Phoenix Development Corporation (DCR) under the names “Strandherd Meadows Inc.” and “1238713 Ontario Limited”.  A plan of subdivision has been registered on the 8.4 ha parcel located immediately to the north of Temporary Road.  The 8.9 ha parcel immediately south of Temporary Road remains undeveloped.  However, it is subject to a draft plan of subdivision, which has been submitted to the City.  In order to consolidate these two parcels, DCR has also submitted an application to close Temporary Road.  Once closed, the developer intends to purchase and incorporate the former roadway into its subdivision, which will ultimately comprise a total area of approximately 18.2 ha.

 

 

DISCUSSION

 

On 7 November 2005, the Program Manager, Development Review South Unit, approved the Road Closing Application submitted by DCR, subject to various standard conditions including a requirement for the applicant to enter into a binding Agreement of Purchase and Sale with the City to purchase the closed road at market value.

 

An agreement was subsequently reached with DCR to purchase the closed road for $142,000.00.  As part of the settlement, the City agreed to transfer to DCR Parts 3, 4, 5, 6, 7, 8 and 10 shown on a draft reference plan prepared by D.A. Simmonds, OLS, of Stantec Geomatics Ltd.  The City further agreed not to charge DCR for any portion of the road allowance that will be used for future roads or parkland.  Accordingly, compensation was based on an area of 3,286 m2, which is the total road allowance area of 7,651 m2, less 4,365 m2, which will be future roads and parkland.

 

As part of the agreement, DCR will, as a condition of subdivision approval, transfer to the City Parts 4 and 6 for road purposes, and Parts 8 and 10 for parkland purposes.  These transfers are to be at no cost to the City.  DCR has also agreed to reimburse the City for appraisal costs.  The agreement is subject to the conditions of the road closing approval and any easements that may be required.

 

The subject property is situated in an area zoned RMU - Residential Mixed Use and PRP - Parks and Recreation.  The purchaser intends to incorporate the subject with the abutting property to facilitate the development of a residential neighbourhood.  The use is consistent with the current zoning.

 

The sale price of the closed road is in keeping with the market value estimated by an independent appraisal report.

 

The offer is considered fair and reasonable and is recommended for acceptance.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The disposal of Temporary Road does not have any natural environment implications.  The road does cross a watercourse and is adjacent to a wooded area, which was assessed as having low significance in the Urban Natural Areas Environmental Evaluation Study.  As a result, the woodland was not recommended for protection through an Urban Natural Features Designation.  Any conditions related to these features in the context of the development proposal are being addressed through the development approvals process.

 

 

CONSULTATION

 

In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning, Transit and the Environment, to determine if the parcel should be retained for a City mandated program.  The Environmental Management Group of the Planning, Transit and the Environment Department was consulted with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report.  Neither the Housing Branch nor any other City Department expressed interest in retaining the property.

 

The utility companies were also circulated and no requirements were indicated.

No concerns were expressed with respect to the sale of the subject property to the abutting owner.

 

The ward Councillor has been made aware of the intent to dispose of the subject property through circulation and supports staff’s recommendation.

 


HOUSING FIRST POLICY

 

The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose. 

 

The Housing First Policy, approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property, to be used in achieving the City’s affordable housing program targets.  The policy also requires that the Official Plan target of 25% affordable housing, be met on any City-owned property sold for residential development.  Where viable, residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund, to be used for the development of affordable housing elsewhere in the City.

 

The subject is a non-viable property in a residential zone and therefore does not meet the affordable housing criteria outlined in the Housing First Policy.

 

 

FINANCIAL IMPLICATIONS

 

This transaction represents revenue of $142,000.00 to the Corporation for the sale of the land, which will be credited to the City’s Sale of Surplus Land Account.
