EXECUTIVE SUMMARY

 

The report recommends that Licensing By-law 2002-189, Schedule 11 relating to Adult Entertainment Parlours be amended to remove 230 Herzberg Road from the list of locations from which the operation of Adult Entertainment Parlours (AEP) is permitted.  A restaurant has been operating at the noted property for over a year.

 

In December, 2005, the owner of the property, and the former licensee were notified of staff’s intention to remove 230 Herzberg from the list of permitted Adult Entertainment Parlour locations. A notice appeared in The Ottawa Citizen, Le Droit and The Ottawa Sun on March 30 and April 6, 2007, advising of the recommendation and inviting the public to present their comments, support or objections in writing before April 12, 2007, or to present their comments in person at the April 19, 2007, Community and Protective Services Committee meeting at which the recommendation will be considered.

 

RÉSUMÉ

 

Le présent rapport recommande la modification de l’annexe 11 du Règlement no 2002‑189 sur les permis, laquelle porte sur les salons de divertissement pour adultes, afin de retirer le 230 du chemin Herzberg de la liste des emplacements où de tels salons sont permis. Depuis plus d’un an, un restaurant est exploité au bien-fonds en question.  

 

En décembre 2005, le propriétaire du bien-fonds et l’ancien détenteur du permis ont été informés de l’intention de la Ville de retirer le 230 du chemin Herzberg de la liste des emplacements où des salons de divertissement pour adultes sont permis. Un avis à cet effet a été publié dans les éditions du 30 mars et du 6 avril 2007 des quotidiens LeDroit, l’Ottawa Citizen et l’Ottawa Sun, afin de rendre la recommandation publique et d’inviter les résidents à faire part à la Ville de leurs commentaires et de leur avis sur la question, par écrit au plus tard le 12 avril 2007 ou en personne à la réunion du 19 avril 2007 du Comité des services communautaires et de protection visant à examiner ladite recommandation.

 

BACKGROUND

 

The Ontario Municipal Act, 2006 - PART IV, entitled LICENCES authorizes a municipality to license, regulate and govern businesses carried on within the municipality. Section 154 (1) of the Act further expands this authority to allow the municipality to define the area of the municipality in which adult entertainment establishments may or may not operate and to limit the number of licences granted in any defined area in which these are permitted.   

 

On August 25, 2004, Council enacted (By-law No. 2004-353) Schedule 11 - Relating to Adult Entertainment Parlours to harmonize and revise regulations that were in effect in pre-amalgamated cities. Section 8 of Schedule 11, prescribes the list of addresses where adult entertainment parlours may operate within the City and defines an area where new AEP could be established.  The listed addresses reflect the location of AEP that operated pre-amalgamation and includes 230 Herzberg Road.

 

DISCUSSION

 

The property located in Ward 4 (Kanata North) known as 230 Herzberg Road has not operated as an Adult Entertainment Parlour for more than two (2) years.  The requisite municipal business licences required to operate an Adult Entertainment Parlour have lapsed.  The premises are currently occupied by a family restaurant.

 

In December 2005, registered letters were mailed to the then current owner of the property and the former Adult Entertainment Parlour (Polar Bare Club) licence holder advising that Community and Protective Services would be recommending to Council that 230 Herzberg Road be removed from the list of permitted locations for Adult Entertainment Parlours.  The letter gave twenty-one (21) days for the recipients to notify the City of any objections.  No objection was received.

 

Community and Protective Services deems it appropriate to remove 230 Herzberg Road from the list of possible addresses to operate an Adult Entertainment Parlour.

 

CONSULTATION

 

In the week of April 2, 2007, a notice was mailed to the owner of the building and to the operator of the restaurant advising them that a recommendation to remove 230 Herzberg Road from the list of addresses from which an Adult Entertainment Parlour can operate would be presented to the CPS Committee and Council before spring 2007.

 

A notice appeared in The Ottawa Citizen, The Ottawa Sun and Le Droit on March 30 and April 6, 2007, outlining the recommendation, inviting written comments and giving notice of the time, date and location at which the Community and Protective Services Committee will consider the recommendation. The notice also invites the public to present comments, objections or support at the Committee meeting in person should they wish to do so.

 

FINANCIAL IMPLICATIONS

 

There are no financial implications related to the approval of the recommendation.

BY-LAW NO. 2007-

 

A by-law of the City of Ottawa to amend Licensing By-law No. 2002-189 respecting adult entertainment parlour location restrictions.

 

The Council of the City of Ottawa enacts as follows:

 

1.                     Paragraph (g ) of Section 8 of Schedule No. 11, Relating to Adult Entertainment Parlours, of By-law No. 2002-189 entitled “A by-law of the City of Ottawa respecting the licensing, regulating and governing of certain businesses”, as amended, is repealed.
