Committee Recommendations
That Council:
1. Declare a vacant parcel of
land shown hatched on Annex “A” attached, containing approximately 704.6 m2 (7,584 square feet), municipally known as 3
and 5 River Bend Drive, described as Lot 215, Registered Plan 404887 (Part 1,
Plan R-43) and part of Lot 216, Registered Plan 404887 (Part 1, Plan 4R-21612),
in the City of Ottawa, as surplus to the City’s needs;
2. Approve the sale of the
land detailed in Recommendation 1, subject to any easements that may be
required, to Total Communication Environment, for the amount of $114,000 plus
GST, pursuant to an Agreement of Purchase and Sale that has been received.

BACKGROUND
The subject property is a vacant parcel of land
legally described as Part of Lots 215 and 216 on Registered Plan 404887. The property is irregular in shape and
contains a total area of 7,584 square feet and is located at the easterly end
of River Bend Drive at the Carling Avenue off ramp to Holly Acres Road.
The property was acquired by the City of Nepean in 1977 from Her Majesty the Queen - Ministry of Transportation, Ontario (MTO). The lots were acquired by MTO for the widening of Carling Avenue and the construction of the Carling Avenue off ramp to Holly Acres Road. The portions conveyed to the City of Nepean were surplus to MTO requirements.
The Purchaser, Total Communication Environment (TCE) is a non-profit organization that provides group homes and support for individuals with developmental delays. TCE is a member of the Developmental Service Network, a network of local support agencies that are working collaboratively to create new group homes in response to the closing of the Rideau Regional facility. The network approached the City with respect to finding single lots suitable for development of group homes. The Housing Branch and the Real Estate Services Division have been assisting in the identification of surplus single-family sites for purchase.
DISCUSSION
As a result of a circulation to all City Departments to determine if there was any City mandated requirement for the property, the site was identified by the City’s Housing Branch as a suitable location for the construction of a group home to support the Provincial Government’s requirement to relocate residents from the Rideau Regional Facility in Smiths Falls.
An agreement has been reached with Total Communication Environment to purchase the subject City property.
The zoning of the City property is R2 – Residential Second Density. The intended use of the subject property by the purchaser is to construct a residential group home. The use is consistent with the zoning and rezoning is not contemplated.
The recommended sale price of $114,000 is supported by an appraisal. The offer is considered fair and reasonable and is recommended for acceptance.
ENVIRONMENTAL IMPLICATIONS
The Environmental Sustainability Division of
Planning, Transit & the Environment Department has confirmed that there are
no environmental implications with the sale of the property.
The Official Plan policy directs that the City make land available for affordable housing and give priority for the sale or lease of surplus City-owned property for this purpose.
The Housing First Policy, approved by Council on 13 July 2005, establishes priority consideration to the Housing Branch in the identification of potentially surplus City-owned property to be used in achieving the City’s affordable housing program targets. The policy also requires that the Official Plan target of 25% affordable housing, be met on any City-owned property sold for residential development. Where viable residential properties are disposed of without a condition requiring an affordable housing component, 25% of the proceeds from the sale are to be credited to a housing fund to be used for the development of affordable housing elsewhere in the City.
The subject is a viable property and meets the affordable housing criteria outlined in the Housing First Policy. The Housing Branch supports the sale to Total Communication Environment (TCE), a non-profit supportive housing provider. TCE is funded by the Provincial Government to provide community based supportive housing for people with developmental delays. The group home to be constructed on this property will house individuals who currently reside in the Rideau Regional facility in Smith Falls, Ontario. This facility is scheduled to close in the near future and many residents will be relocated to Ottawa and the surrounding area.
CONSULTATION
In accordance with policies approved by City Council on 14 November 2001, the availability of the property was circulated to all client City Departments, including the Housing Branch, Public Works and Services and Planning, Transit and the Environment, to determine if the property should be retained for a City mandated program. The Environmental Management Group of the Planning, Transit and the Environment Department was consulted with respect to the Greenspace Master Plan and their comments are indicated under the Environmental Implications section of this report. No Department expressed interest in the property other than the Housing Branch.
The utility companies were also circulated and there is no plant requiring easement protection in the parcel being sold.

No concerns were expressed with respect to the sale of the subject property.
The ward Councillor is aware of the sale of this property to the group home provider.
FINANCIAL IMPLICATIONS
This transaction represents revenue of $114,000 to the Corporation and will be credited to the City’s Sale of Surplus Land Account.

DISPOSITION
Following Council’s approval, Real Property Asset Management and Legal Services Branches will finalize the transaction.
