That Council
approve that By-law 2001-8 to appoint the Lottery Licensing Officer and a
Lottery Investigator for the City of Ottawa be repealed and replaced with the
by-law attached as Document 1, to appoint said Officer and Investigators to
reflect organizational changes.

RECOMMENDATION
That the Community and
Protective Services Committee recommend to Council that By-law 2001-8 to
appoint the Lottery Licensing Officer and a Lottery Investigator for the City
of Ottawa be repealed and replaced with the by-law attached as Document 1, to
appoint said Officer and Investigators to reflect organizational changes.

EXECUTIVE SUMMARY
The
report recommends the repeal of By-law 2001-8 to appoint the Lottery Licensing
Officer and a Lottery Investigator for the City of Ottawa and its replacement
with a by-law that appoints the current relevant positions and individuals to
reflect organizational changes.

Le rapport recommande l’abrogation du Règlement
municipal 2001-8 visant la nomination de l’agent des licences de loterie et de
l’inspecteur des loteries de la Ville d’Ottawa et son remplacement par un
règlement faisant en sorte que la nomination de cet agent et de cet inspecteur
tienne compte des changements apportés à l’organisation.
BACKGROUND
At the time of amalgamation, the
functions of the Lottery Licensing Officer fell within the area of
responsibility of the Director of Secretariat Services in the Department of
Corporate Services. The responsibilities
of this designation include exercising all authority,
powers and rights and to perform all duties and obligations which by statute or
by-law are or may be conferred or imposed and any other duties that may be
imposed by the Council of the City of Ottawa in respect of lottery
licensing. By-law 2001-8 identifies
that position and also appoints a Lottery Investigator to assist in the
administration and enforcement of the licensing of lottery schemes that are or
may be regulated by statute or by-law.
DISCUSSION
By-law 2001-8 to appoint the Lottery Licensing Officer and a Lottery Investigator for the City of Ottawa has not been amended since 2001 when it was enacted and therefore, it continues to identify individuals who are no longer involved in the lottery licensing function which was transferred to the By-law and Regulatory Services Branch as part of the 2004 reorganization. The proposal to repeal By-law 2001-8 and to replace it with a by-law that appoints the current relevant positions and individuals will address this administrative matter.

There are no rural implications associated with the recommendation.

Given the administrative nature of the
recommendations, no public consultation is necessary and none was undertaken.

BY-LAW NO. 2007 -
A by-law of the City of Ottawa to appoint a Lottery Licensing Officer and Lottery Investigators and to repeal By-law No. 2001-8.
The Council of the City of Ottawa enacts as follows:
1. The person appointed to the position of
Director of By-law and Regulatory Services in the Department of Community and
Protective Services of the City of Ottawa is appointed Lottery Licensing
Officer of the City of Ottawa and shall exercise all the authority, powers and
rights and shall perform all duties and obligations which by statute or by-law
are or may be conferred or imposed upon the Lottery Licensing Officer and any
other duties that may be imposed by the Council of the City of Ottawa.
2. The following individuals
are appointed as Municipal Law Enforcement Officers, known as Lottery
Investigators, to assist in the administration and enforcement of the licensing
of lottery schemes that are or may be regulated by statute or by-law:

No. 2001-8 entitled “A by-law of the City of Ottawa to appoint the Lottery
Licensing Officer and a Lottery Investigator for the City of Ottawa” is
repealed.
