This report recommends restricting driving instruction within a defined area adjacent to the Ministry of Transportation Test Centre at 5303 Canotek Road. This action is recommended to stem the increased traffic volume created by driving school instruction on nearby residential streets.
A notice appeared in the Ottawa Citizen and Le Droit on January 26, 2007, and February 2, 2007 in Le Droit and February 3, 2007 in the Ottawa Citizen advising of the recommendation and inviting the public to present their comments, support or objections in writing before February 5, 2007, or in person at the February 15, 2007, Community and Protective Services Committee at which the recommendation will be considered. A similar notice was mailed to licensed driving school operators and driving school instructors during the week of February 5, 2007.
BACKGROUND
Section 150 of the Municipal Act grants municipalities the authority to license, regulate and govern any business wholly or partly carried on within the municipality even if the business is being carried on from a location outside the municipality.
On April 10, 2002, Council approved the licensing and regulating of Driving School Operators and Driving Instructors who operate within the City of Ottawa. Currently approximately 42 Driving Schools Operators and 113 Driving Instructors are licensed.
In October 2003, the Ministry of Transportation of Ontario established a Drive Test Centre at 5303 Canotek Road. Adjacent residential streets are used by Driving Schools for driver training.
In November 2005, the City of Ottawa notified licensed Driving Schools to modify their practice routes in order to reduce the related traffic volume on the residential streets adjacent to the testing facility.
ANALYSIS
Monitoring of residential streets adjacent to the Test Centre at 5303 Canotek Road revealed that a prohibition of driving instruction by licensed driving schools in the immediate vicinity of the test centre is justified. A similar provision enacted in the City of Toronto has been successful in reducing prohibited traffic within a designated radius around Test Centres.
A significant increase in traffic in the nearby residential area has been noted, and in 2006 alone some thirty (30) complaints have been received by Beacon Hill-Cyrville Ward’s Office. In addition to local residents, the Ministry of Transportation Test Centre at 5303 Canotek Road has voiced its concerns regarding the volume and frequency of driving school traffic in their test area.
Community and Protective Services recommends that driving schools be prohibited from offering driving instruction in the area North of Montreal Road, South of the Rockcliffe Parkway, West of Shefford Road and East of Blair Road as indicated in the proposed Section 20 and illustrated in Appendix “A” of the attached amending by-law.
The restriction does not affect the main roadways listed but includes the residential streets within the area bordered by the main roadways. Despite the restriction, driving instructors will be allowed to pick up and drop off students living within the restricted zone, and use of the driving school vehicle will be permitted within the area for driving exams conducted by the Ministry of Transportation.
If approved the proposed restriction will benefit area residents by reducing the influx of driving school vehicles and alleviate concerns related to people practicing three-point turns and parallel parking in their community.
In 2005, a notice was mailed to Driving School Operators to advise the driving instructors to modify their practice routes away from residential streets adjacent to the Test Centre. The notice further indicated that failure to achieve voluntarily compliance could result in the introduction of a chargeable offence under the Licensing By-law. The notice failed to produce the desired results.
On August 25,
2006, between 9:30 a.m. and
2:30 p.m. a By-law Officer monitored the traffic volume surrounding the
Test Centre at 5303 Canotek Road. The officer observed 10 driving
school vehicles within the residential area adjacent to the testing centre.
Typically the driving school vehicles entered into the adjacent residential
area by way of Loyola Avenue. Of the 10 vehicles three accessed Eastvale and
then moved onto streets such as Casey, Hubbard and Bickerton. All vehicles were observed practicing
parallel parking and 3-point turns on the residential streets.
A number of complaints have been
received alleging that some driving instructors are removing their vehicle
markings (roof signs) while in the area. This may indicate that Driving Schools
are attempting to conceal their activities and knowingly contravene the intent
of the notice. Driving School roof
signs warns other motorists of the proximity of inexperienced drivers in
training. As such, removal of the
roof sign is a violation of the Licensing By-law requirements and creates a
safety risk to the community.
CONSULTATION

BY-LAW 2007-
A by-law of the City of Ottawa to amend By-law No. 2002-189 respecting the licensing, regulating and governing of Driving School Operators and Driving School Instructors.
The Council of the City of Ottawa enacts as follows:
1. Schedule No. 2, Driving School Operators and Driving School Instructors, of By-law No. 2002-189 entitled “A by-law of the City of Ottawa respecting the licensing, regulating and governing of certain businesses”, as amended, is amended by adding the following heading and sections immediately after Section 19:
PROHIBITED AREA
20. No licensee shall offer or provide or permit the offering or provision of driving instruction within the area bounded on the south by the north side of Montreal Road, on the east by the west side of Shefford Road, on the south by the Rockcliffe Parkway and on the west by the east side of Blair Road more particularly described in Appendix “A” and hereinafter referred to as the “Area”.
21. Section 20 shall not apply to:
(a) a licensee engaged in picking up or dropping off a student driver in the Area; or
(b) an official of the Ministry of Transportation when conducting the driving exam in a driving school vehicle.
2. This by-law includes Appendix “A” annexed hereto and Appendix “A” is hereby declared to form part of this by-law.

faire part de ses commentaires, de son appui ou de son opposition par écrit au
plus tard le 5 février 2007, ou en personne à la réunion du
15 février 2007 du Comité des services communautaires et de la
protection, où la recommandation sera examinée. Un avis semblable a été envoyé
par la poste aux exploitants et aux moniteurs d’autos-écoles détenteurs d’un
permis pendant la semaine du 5 février 2007.
CONTEXTE
L’article 150 de la Loi sur les
municipalités accorde aux municipalités le pouvoir d’attribuer les permis et de
réglementer et de régir toutes les activités commerciales exercées en totalité
ou en partie dans la municipalité même si l’entreprise est située dans un lieu
à l’extérieur de la municipalité.
Le 10 avril 2002, le
Conseil municipal a approuvé le règlement sur la délivrance de permis aux
exploitants et moniteurs d’autos-écoles qui exercent leur activité dans la
ville d’Ottawa et les régissant. À l’heure actuelle, environ
42 exploitants et 113 moniteurs d’autos-écoles sont détenteurs d’un
permis.
En octobre 2003, le ministère
des Transports de l’Ontario a établi un centre d’épreuve de conduite au
5303, chemin Canotek. Les autos-écoles utilisent les rues résidentielles
adjacentes pour la formation des conducteurs.
En novembre 2005, la Ville
d’Ottawa a demandé aux autos-écoles détentrices d’un permis de modifier leurs
itinéraires d’exercice afin de réduire le volume de la circulation dans les
rues résidentielles adjacentes au centre d’épreuve.
ANALYSE
Après avoir surveillé la circulation
dans les rues résidentielles adjacentes au Centre d’épreuve du
5303, chemin Canotek, nous avons constaté qu’il est justifié d’interdire
les leçons de conduite automobile par les autos-écoles détentrices d’un permis
dans le voisinage immédiat du centre d’épreuve. Une disposition semblable adoptée
par la Ville de Toronto a eu pour effet de réduire la circulation interdite
dans un rayon déterminé autour des centres d’épreuve.
Une forte augmentation de la
circulation dans la zone résidentielle adjacente a été constatée et, en 2006
seulement, environ trente (30) plaintes ont été reçues par le bureau du
quartier Beacon Hill-Cyrville. Outre les résidents locaux, le centre d’épreuve
du ministère des Transports, au 5303, chemin Canotek s’est dit préoccupé
par le volume et la fréquence de la circulation des véhicules des autos-écoles
dans le secteur où se font les épreuves.
Le Comité des services
communautaires et de la protection recommande qu’il soit interdit aux
autos-écoles d’offrir des leçons de conduite automobile dans le secteur au nord
du chemin Montréal, au sud de la promenade Rockcliffe, à l’ouest du chemin
Shefford et à l’est du chemin Blair, comme il est indiqué à l’article 20
proposé et illustré à l’annexe A du règlement municipal portant
modification ci‑joint.
L’interdiction ne porte pas sur les
grandes artères mentionnées, mais plutôt sur les rues résidentielles dans le
secteur délimité par les grandes artères. Malgré l’interdiction, les moniteurs
d’autos-écoles auront le droit de prendre à bord et de laisser descendre les
étudiants qui vivent dans la zone interdite et l’utilisation du véhicule de
l’auto-école sera autorisée dans le secteur pour les épreuves de conduite
tenues par le ministère des Transports.
Si elle est approuvée,
l’interdiction proposée sera avantageuse pour les résidents du secteur du fait
qu’il y aura moins d’autos-écoles et qu’ils seront moins dérangés par ceux qui
s’exercent à faire des virages trois points et à stationner en parallèle dans
leur rue.
En 2005, les exploitants
d’autos-écoles ont reçu par la poste un avis demandant à leurs moniteurs de
modifier leurs itinéraires afin de ne pas circuler dans les rues résidentielles
adjacentes au centre d’épreuve. Il était aussi indiqué que, faute de se
conformer volontairement à cette directive, les moniteurs pourraient être
accusés d’une infraction assortie d’une amende selon le règlement sur les
permis. L’avis n’a pas produit les résultats escomptés.
Le 25 août 2006, entre
9 h 30 et 14 h 30, un agent chargé de faire respecter les
règlements municipaux a surveillé la circulation autour du centre d’épreuve au
5303, chemin Canotek. Il a constaté la présence de 10 autos-écoles
dans le secteur résidentiel à proximité du centre d’épreuve. Généralement, les
véhicules pénétraient dans le secteur résidentiel adjacent par l’avenue Loyola.
Sur les 10 véhicules, trois sont arrivés sur Eastvale et se sont ensuite
déplacés sur des rues comme Casey, Hubbard et Bickerton. On a constaté que tous
se sont exercés à faire du stationnement parallèle et des virages trois points
dans les rues résidentielles.
Des plaignants ont allégué que
certains moniteurs d’autos-écoles enlèvent les marques de leur véhicule (les
affiches sur le toit) pendant qu’ils sont dans le secteur, ce qui peut indiquer
que les écoles de conduite cherchent à dissimuler leurs activités et
contreviennent sciemment à l’esprit de l’avis. Les affiches sur le toit des
autos-écoles servent à indiquer aux autres automobilistes la présence de
conducteurs sans expérience en formation. C’est ainsi que si l’affiche est
enlevée, on contrevient aux règlements sur les permis et on pose un risque pour
la sécurité dans les environs.

d’autos-écoles et aux moniteurs pendant la semaine du 5 février 2007.
Il n’y a pas de répercussion
financière à la suite de ce rapport.

Règlement de la Ville
d’Ottawa visant à modifier le règlement no 2002‑189 sur
la délivrance de permis aux exploitants et moniteurs d’autos-écoles et les
régissant.
Le
Conseil municipal de la Ville d’Ottawa adopte les dispositions suivantes :
1. L’Annexe
no 2 régissant les exploitants et moniteurs d’autos-écoles du
règlement municipal 2002‑189 intitulé « Règlement de la Ville
d’Ottawa en matière de délivrance de permis, de réglementation et de régie de
certaines entreprises », avec ses modifications, est modifiée par l’ajout
du titre et des articles ci‑après immédiatement après
l’article 19 :

20. Le
détenteur de permis ne doit pas enseigner ou faire enseigner la conduite
automobile dans le secteur borné au sud par le côté nord du chemin de Montréal, à l'est pas le côté ouest
du chemin Shefford, au sud par la promenade Rockcliffe et à l'ouest par le côté
est du chemin Blair et décrit avec plus de précision dans l'appendice A
(ci-après appelé le « secteur »).
21. L'article 20 ne s'applique
pas :
a) à un détenteur de permis
qui accompagne, à l'aller ou au retour, un élève dans le secteur;
b) à un fonctionnaire du ministère des
Transports qui administre une épreuve de conduite dans un véhicule d'une
auto-école.
2. Le
présent règlement comprend l’annexe A annexée aux présentes et
l’annexe A est déclarée par la présente faire partie du présent règlement.
