4184, chemin Spratt de zone de commerce de quartier (CN) à zone de commerce de
quartier assortie d’une exception (CN-XX), comme il est expliqué en détail dans
le document 2.
BACKGROUND
The
subject property is located on the northwest corner of Spratt Road and Canyon
Walk Drive. The property is 6402 m2 in
area. The applicant is now constructing
a one-storey commercial plaza on the site.
This commercial block is surrounded by residential uses to the east and
west.
To
the north is a large public park and there is a public elementary school in the
south east corner of Spratt and Canyon Walk Drive. The block was created by the plan of subdivision to provide space
for small community orientated businesses.
The commercial plaza is nearing completion and is actively trying to attract tenants. One of the proposed tenants would like to operate a veterinary clinic. At this time the Commercial Neighbourhood Zone does not permit veterinary clinic and therefore a Zoning By-law amendment is required.
DISCUSSION
The
site is designated General Urban Area, which allows for the Zoning By-law to
determine where commercial uses and services that provide for the local,
everyday needs of the residents are to be located. The Official Plan requires that Zoning By-law amendments ensure
that the uses complement the adjacent residential uses and are consistent with
the scale around it.
The
site is now zoned Commercial Neighbourhood Zone. The list of permitted uses does not include a veterinary clinic.
The intent of the proposed Zoning By-law amendment is to create an exception
zone that will permit a veterinary clinic on this site. By adding this use there will be no
additional parking required on the site and the traffic generated would be
consistent with other permitted uses.
Permitting veterinary clinic on this property is consistent with the policies of the Official Plan by creating a mix of non-conflicting uses to service the residents around it. Staff recommend approval of this application.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and supports the staff recommendation. The City did receive one negative comment from a neighbouring property owner opposed to this application. Their concerns are that a clinic is too close to residents and there is the potential to introduce diseases, attract strays and create noise.
Staff have discussed these concerns with the Riverside South Community Association. The Association does not share the opinion and many of their members would like the veterinary clinic to open to provide health care for the neighbourhood pets. Staff have also contacted the Public Health Department and there was no concerns with disease. The applicant has advised staff that animals receiving care will be brought by their owners and will be housed inside, which will limit any noise.

This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-law amendment
applications.
