That Council approve an amendment to the former Township of West

Road from MR (Rural Industrial) to MR-29 (Special Rural Industrial) as
shown on Document 1 and as detailed in Document 2; and that

Document 1 (Location Map) to the report be
substituted with the attached revised Location Map which reflects the affected
lands; and
2.
Document 2 to the Report be revised to delete all
references to “MR-14” and replace the references with “MR-29”; to delete the
line that reads “Notwithstanding the provisions of Section 16(1)(b) hereof to
the contrary” in its entirety; and to delete the line that reads “shall only”
and replace it with “may also.”
THAT pursuant to the Planning
Act, subsection 34(17) no further notice be given.

That the Agriculture and Rural Affairs
Committee recommend Council approve an amendment to the former Township of West
Carleton Zoning By-Law to change the zoning of 107 and 111 Westhunt Road from
MR (Rural Industrial) to MR-14 (Special Rural Industrial) as shown on Document
1 and as detailed in Document 2.

BACKGROUND
The
subject site, 107 and 111 Westhunt Road, is located on the north side of
Westhunt Road, just east of the intersection with Carp Road. Westhunt Road is located north of Highway
417 and east of Carp Road in the West
Carleton Ward.
The
property at 107 Westhunt Road is currently used to store containers, while the
property at 111 Westhunt Road is currently vacant undeveloped land. The lands surrounding the site are zoned to
permit rural industrial uses and have either been developed for this purpose,
or are currently vacant undeveloped lands.
The
subject lands are currently zoned as MR (Rural Industrial). This application proposes to change the
zoning on the site to MR-14 (Special Rural Industrial) to permit a recycling
transfer depot. The proposed use will
involve the processing, transfer and temporary storage of recyclable materials.
This
application was previously scheduled for a Planning and Environment Committee
meeting on 22 November 2005, however, the applicant requested deferral of the
item to consider additional uses for the site.
After consultation with staff, the applicant has since decided to
proceed with the application as originally submitted.
DISCUSSION
Provincial Policy Statement (PPS)
The PPS includes policies that promote economic
opportunities in rural areas. To meet
this goal, an appropriate range of employment shall be provided, including
industrial, commercial, and institutional uses. The proposed development is consistent with the policies in the
PPS as this light industrial use contributes to the variety of employment uses
in the Carp Road corridor, and thus, the rural area.
Official Plan
The subject lands are designated as "Carp
Road Corridor Rural Employment Area" on Schedule A, Rural Policy Plan of
the Official Plan. The intent of this
designation is to reserve land for rural industrial and commercial uses. All new development must conform to the
policies of the Carp Road Corridor Community Design Plan.
Carp Road Corridor Community Design Plan
(CRCCDP)
The subject lands are designated as "Light
Industrial Area" on Schedule 1 of the CRCCDP. The intent of this designation is to ensure that future uses are
consistent with the present uses, which are predominately light industrial
uses, such as construction, manufacturing, and warehousing. A recycling plant is a permitted use within
this designation. As well, the CRCCDP
indicates that permitted uses should be appropriately located and well designed
so as to minimize nuisance or interference with existing or proposed uses of
adjoining lands, and measures such as landscaping screening, buffering shall be
used to reduce the impact of industrial uses on adjacent properties. These site issues will be addressed through
a future Site Plan Control application process. In addition to Site Plan Control approval, the site would
also be required to obtain a Certificate of Approval from the Ministry of the
Environment.
The proposal conforms with the policies in the
CRCCDP, and therefore the Official Plan, in that the proposed recycling
transfer depot is consistent with the intent and permitted uses of the Light
Industrial Area designation.
Zoning By-law
The current MR (Rural Industrial) zone permits
industrial uses, including a manufacturing plant, warehouse, building supply
outlet, and maintenance garage. The MR
zone does not permit processing, transfer, or storage of recyclables.
The proposed MR-14 (Special Rural Industrial)
zone will specifically permit a depot for the temporary storage, sorting, and
packing of clean recyclable materials, as well as operational uses associated
with these uses. The details of the
proposed zoning are outlined in Document 3.
Because the site is surrounded by light industrial uses of varying type,
the proposed use represents compatible development. This use does not present any foreseeable conflicts with the
adjacent rural industrial uses or potential future uses.
Summary
The proposed Zoning By-law amendment is appropriate because it conforms to the policies set forth in the Provincial Policy Statement, Official Plan, and the Carp Road Corridor Community Design Plan, and is compatible with adjacent uses and zones. The location of the proposed recycling transfer depot is in a rural industrial area, thereby reducing the potential for conflicts with adjacent land uses. As a result, staff support the proposed Zoning By-law amendment from MR (Rural Industrial) to MR-14 (Special Rural Industrial) to permit a recycling transfer depot.
The rezoning of the land to a Special Rural Industrial Zone designation is in keeping with surrounding land uses and Official Plan policies. It allows for the expansion of a rural business and supports the provision of additional employment in the rural economy.
CONSULTATION
Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.
FINANCIAL IMPLICATIONS
N/A
This application was not processed by the "On
Time Decision Date" established for the processing of Zoning By-Law
Amendment applications because the applicant requested deferral of the item to
consider additional uses on the site.
