REPORT RECOMMENDATION
That the Planning and Environment Committee recommend Council approve
an amendment to Zoning By-law Number 132-93 of the former City of Kanata to
amend the existing zone for 4055 Carling Avenue to permit a "Veterinary
Clinic" as shown in Document 1 and detailed in Document 2.

BACKGROUND
The subject property, 4055
Carling Avenue, was historically known as 4065 Carling Avenue. It
is located on the north side of Carling Avenue, east of March Road, in the
Kanata North Business Park. The property includes a 2,147 square metre
commercial plaza with 92 parking spaces. The surrounding land uses
include: office complex to the north and west, restaurant to the east, and a
railway and the Gateway Mall located on the south side of Carling Avenue.
The proposed veterinary clinic represents 6.1% of the total 2,147 square metres building envelope.
The current zoning “ C2S(1) ” (Commercial-Special) permits any uses in the C2 Zone plus an Automotive Lubricant Centre; an Automotive General Repair Garage; an Automotive Parts and Accessory Store; an Automotive Sales/rental Centre; an Automotive Specialty Repair and Service Centre; Business, Financial and Professional Offices; an Automotive Mall; a Retail Store; a Recreational Establishment; and Personal Services Store.
The applicant proposes to amend the By-law to add 'Veterinary Clinic' as an additional permitted use in the 'Commercial' C2S(1) Zone.
DISCUSSION
City Council Approved Official Plan
The City Council Approved Official
Plan designates the site as 'Employment Area' which permits a variety of
industrial and employment generating uses. In addition the designation permits
a range of complementary uses such as convenience retail, personal business
services, and recreational uses to serve the employees of the Enterprise Areas,
general public in the immediate vicinity and the travelling public. A ‘Veterinary Clinic’ is a
compatible and complementary use in the ‘Employment Area’.
The applicant is proposing to amend
the Zoning By-law 132-93, C2S(1) for the subject property located at 4055
Carling Avenue to permit the 'Veterinary Clinic' use as well as the existing
uses. The development standards will continue to be the same as the current
zoning with the added provision that the veterinary clinic may not be more than
140 square metres. This size limitation is recommended to retain the diversity of
services available within the commercial plaza.
The requested amendment is
considered an appropriate use for the site. It is anticipated that the
veterinary clinic will take pressure off the existing over crowded parking
situation in the plaza by replacing a former restaurant use. The veterinary
clinic offers a service to nearby employees and has no detrimental impact on
the surrounding development.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation. The City did not receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-law amendment
applications.

By-law 132-93 (C2S(1)) Zone be amended as follows:
1. A Veterinary Clinic be added as a new permitted use to the C2S(1) Zone subject to the following:
a) the use cannot be more than 140 square metres in area.
2. Subsection 7.2, Development Standards, of By-law 132-93 be amended to ensure that the C2S(1) zone is subject to the development standards of the base C2 zone.
