That Council approve:

 

1.   That an amendment to the former City of Cumberland Zoning By-law to change the zoning of 905 Taylor Creek Drive from MS2 - Industrial Service to MS1 (XX) - Industrial Service Exception as shown in Document 1 and as detailed in Document 2.

 

2.   That the implementing Zoning By-law proceed to City Council for approval after the decision of the Ontario Municipal Board is issued with respect to the appeals of the Employment Area policies in the Official Plan of the City of Ottawa and the policies are in full force and effect.

BACKGROUND

 

The site is located at the north-west corner of the intersection of Trim Road and Taylor Creek Drive, south of Regional Road 174 and north of St. Joseph Boulevard. The subject land is currently vacant. The site encompasses an area of approximately .99 hectares and is irregular in shape. Frontage exists along Taylor Creek Drive and Trim Road. The property lies within the Taylor Creek Business Park and across from the Cardinal Creek Business Park.  The Orléans Bowling Centre is located immediately north of the property and Mr. Gas is across Taylor Creek Drive to the south.  Predominantly vacant tracts exist east of the lands in the Cardinal Creek Business Park, however there are some uses including a new municipal Park and Ride and Agropur Cooperative facility. 

 

Proposed Zoning

 

The applicant is proposing to change the former City of Cumberland Zoning By-law, which defines the property as MS2 - Industrial Service, to an MS1 (XX) - Industrial Service Exception.  This zone already permits service commercial uses such as a bank, restaurant (full service, fast food and take-out) and offices.  The MS1 (XX) would permit a retail store in addition to the permitted uses in the parent zone.

 

 

DISCUSSION

 

City Council Approved Official Plan

 

The City Council Approved Official Plan designates the lands Employment Area.  One of the key objectives of this Plan is to protect lands primarily for employment uses such as offices, manufacturing, warehousing, distribution, research and development facilities and utilities in order that they remain affordable for employment purposes and that they develop over time without conflict from competing land uses.

 

Lands designated Employment Area have the ability to accommodate at least 2,000 jobs and are located in proximity to major highways or arterials allowing good truck access.  This designation is meant to also permit a variety of complimentary uses, such as recreational, health and fitness uses, child care and service commercial (convenience store, medical offices, restaurant, bank and personal service establishments) which will occupy small sites as part of a small plaza to serve employees of Employment Areas, the general public in the immediate vicinity and passing traffic.

 


Former Regional Official Plan

 

The Former Regional Official Plan designated these lands Business Park.  This designation permitted warehousing, manufacturing and other related non-residential uses such as retail, office, small-scale institutional and recreation uses.  Development proposals in the Business Park designation should consider the mix of land uses to provide basic goods and services to employees of the park within reasonable walking distances to the places of employment.

 

Former Cumberland Official Plan

 

The Former Cumberland Official Plan designated these lands Mixed Use Business Park – Category A which encourages the development of high density employment nodes near public transit as well as an array of goods and services conveniently available to reduce the number and length of trips and to support higher levels of transit service.

 

Details of Proposed Zoning By-law

 

The Zoning By-law amendment proposed complies with the policies in the City Council Approved Official Plan which allow this type of retail development as a complementary use to the surrounding employment uses within a business park. The MS1 zone permits a variety of employment-generating and service commercial uses which are consistent with the Official Plan policies.  Several parcels which exist in the Taylor Creek Business Park are currently zoned MS1.

 

It is of note that the lands on the east side of Trim Road, south of Dairy Drive, are zoned Community Commercial (CC and CC-X2).  The development of this 10-hectare parcel for commercial purposes would service the day-to-day retail needs of the surrounding business parks, however there are no active applications to develop the lands.  The rezoning of the subject lands will address the immediate convenience retail needs of the area.

 

Conclusions

 

This application conforms to the City Council Approved Official Plan, Employment Area policies as amended by Official Plan Amendment 28 and will provide a convenient commercial and service development to serve the needs of the employment area as well as the neighbouring community. This Zoning By-law amendment cannot be adopted by Council before the Ontario Municipal Board issues a decision with respect to the appeals to the Employment Area policies in Official Plan Amendment 28.  The applicant therefore wishes to process this application under the current policies with an understanding that there will not be any status granted to the proposed amendment until the Employment Area policies of the 2003 City Council approved Official Plan as amended by Official Plan Amendment 28 are in full force and effect.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

 

 

FINANCIAL IMPLICATIONS

 

N/A

 

 

APPLICATION PROCESS TIMELINE STATUS

 

The application was not processed by the "On Time Decision Date" established for the processing of Zoning By-law amendments because the local Offical Plan and City Council Approved Official Plan policies did not allow retail uses in a stand alone plaza in this business park.  Official Plan Amendment No. 28 introduced policies which allow this type of retail development as a complementary use to the surrounding employment uses. The Ontario Municipal Board has considered appeals in respect of Official Plan Amendment No. 28 and a decision with respect to these appeals is imminent.
