That Council approve:
1.
The granting of a
License of Occupation to Waste Services (CA) Inc. permitting the construction,
operation and maintenance of a leachate forcemain from the Waste Services (CA)
Inc. Landfill Site located on Navan Road between Page Road and Mer Bleue Road
in form satisfactory to the City Solicitor and the Deputy City Manager Public
Works and Services.
2.
The
entering into a Leachate Agreement with Waste Services (CA) Inc to allow Waste
Services (CA) Inc. to dispose site leachate from the Navan Road Landfill into
the City’s sanitary sewer system in form satisfactory to the City Solicitor and
the Deputy City Manager Public Works and Services.
3. That the agreement with Waste
Services (CA) Inc. ensure that the information gathered in the monitoring and
reporting program to be submitted to the Deputy City Manager Public Works and
Services, specifically:
a) the quality and quantity of the
leachate and compliance with the City Sewer Use By-law; and
b) the on-line atmospheric monitoring
data and the chemical analysis data be made available to City Council and the
public through interim and annual reports.

La conclusion d’un accord sur le

d’évacuer le lixiviat provenant de la décharge du chemin Navan dans le réseau
d’égouts séparatifs de la Ville, et ce, d’une manière qui donne satisfaction à
la fois au chef du contentieux et au directeur municipal adjoint des Services
et Travaux publics.
3. Que
l’accord conclu avec Waste Services (CA) Inc. garantisse que l’information
recueillie dans le cadre du programme de suivi et de communication de rapports
soit présentée au directeur municipal adjoint des Services et Travaux publics,
en ce qui a trait plus particulièrement :
a) à la
qualité et à la quantité du lixiviat et la conformité avec le Règlement
municipal sur les égouts; et
b) aux
données en ligne sur l’observation atmosphérique et les analyses chimiques, qui
devront être mises à la disposition du Conseil municipal et de la population au
moyen de rapports annuels et provisoires.

BACKGROUND
Waste Services (CA) Inc. (WSI) is
the owner and operator of the Navan Road Landfill Site on Navan Road between
Pagé Road and Mer Bleue Road. The
landfill has been in operation since the 1960's and receives solid
non-hazardous industrial, commercial, institutional and dry domestic waste from
within the City of Ottawa, recycling from eastern Ontario/Outaouais and
composting from Ontario/Quebec.
Leachate from the Navan Landfill
site has been transported by tanker truck to the Robert O. Pickard
Environmental Centre (ROPEC) for wastewater treatment since 1997. In 1999, a long-term leachate management
plan was prepared by Huneault (former site owner) which called for the
continued disposal of leachate to ROPEC.
WSI have continued to haul leachate to ROPEC to date.
Construction of the Forest Valley Pump Station and gravity sanitary sewers on Renaud Road and Pagé Road has recently been completed. This has provided an opportunity to discharge the leachate to the City’s sewer system via a forcemain from the WSI Landfill Site (Document 1).
For some time the community
surrounding the landfill site has expressed concerns with the number of tanker
trucks travelling on Navan Road. The construction
of the leachate forcemain would remove the need for tanker trucks. Construction of a forcemain is intended to
deal with current conditions and does not imply support or approval for
expansion to the landfill site.
The connection to the City sewer
system is in accordance with the Master Plan for the current Landfill and the
Water Management Systems Report (1998 Revisions Leachate Management) prepared
by Castonguay Technologies Inc. for WSI.
DISCUSSION
To allow the construction, operation and maintenance of the forcemain, WSI will be required to enter into two agreements with the City as follows:
The Licence of Occupation sets
out the terms and conditions for the construction, operation and maintenance of
the privately-owned forcemain within the City's municipal right-of-way, namely
Navan Road and Renaud Road.
The forcemain to be constructed
and owned by WSI is solely to service the existing landfill site. The agreement sets forth that no other
connections will be permitted to the leachate pipe. The proposed Licence of Occupation Agrement provides for the
following:
The Leachate Agreement defines
the quantity and quality of the leachate being discharged from the site into
the City's sewer system. The agreement
will be for a one-year term, with provision for renewal on an annual basis.
The maximum quantity and
discharge rates of leachate by WSI from the Landfill Site will be stipulated in
the agreement and is required to address existing site requirements only. The agreement will not include any
provisions for expansion of the site.
Included in the Agreement are
requirements for the monitoring of the discharge at established frequencies and
at an agreed upon location. The
monitoring protocol will be clearly set out in the Agreement and will include
the protocols to be followed in the case of a system failure or shutdown. All costs for testing and monitoring,
including the calibration of monitoring equipment to the satisfaction of the
Deputy City Manager for Public Works and Services, shall be borne by WSI.
The conditions imposed on WSI for
the discharge into the City of Ottawa sewer system may be reassessed and
modified by the Deputy City Manager of Public Works and Services from time to
time. The Leachate Agreement contains
contingency plans for the aceptance of leachate by tanker truck to ROPEC in the
event the forcemain is shutdown for a period in excess of 72 hours. Conditions
for the hauling and dischage to ROPEC, including the quality parameters and
fees to be paid, will be included in the Agreement.
ENVIRONMENTAL IMPLICATIONS
The forcemain will be constructed of high-density polyethylene (HDPE) with pipe joints that are butt-fused to eliminate open joints.
All properties abutting the forcemain are serviced by municipal water
WSI will be required to conduct on an annual basis during the term of this Agreement a pressure test to verify the integrity of the forcemain.
There have been a number of Public Meetings surrounding the WSI Landfill Site. On 02 June 2005, WSI held an Open House at the Notre Dame des Champs Recreation Centre. WSI distributed notices throughout the Notre Dame des Champs community and posted signs at the WSI office on Navan Road two weeks in advance of the meeting. The proposed route for the forcemain along Navan Road was posted for review at the Open House. The only comments received were related to the potential hook up to future gravity sanitary sewers.
The proposed forcemain was again discussed at an Open House held by the Friends of Mer Bleu in early 2006. Presentations were made by representatives of the Ministry of the Environment and the City of Ottawa, among others. There were no comments received in opposition to the forcemain. Comments were received regarding the ongoing impacts of tanker trucks hauling leachate.
While the community has expressed concerns with expansion plans to the landfill site, it has supported the construction of the forcemain since this is required to service the existing site and will have the benefit of removing the leachate tanker trucks.
FINANCIAL IMPLICATIONS
WSI will pay a fee for the discharge of the leachate into the City's sewer system. It will include a fee for the water from a separate source and, where applicable, a fee for treatable parameters identified in Schedule "A" to the agreement yielding the highest discharge fee based on a minimum of seven (7) monitoring days, as determined by the Deputy City Manager for Public Works and Services.
WSI will also be required to pay
an annual fee of $7,400 for the use of the public right-of-way.
