as shown in Document 1 and detailed in Document 2.

rurales recommande au Conseil d’approuver une modification au Règlement de
zonage de l’ancien Canton d’Osgoode en vue de changer la désignation de zonage
des 1171 et 1175, chemin River de Ru (zone rurale) à Ru [x] (zone rurale
assortie d’une exception), tel qu’il est indiqué dans le document 1 et expliqué
en détail dans le document 2.
BACKGROUND
The subject property is located on the east side of River Road, south of Mitch Owens Road. The 35-hectare farmland is vacant and surrounded by residential uses to the west, across River Road, residential and vacant rural lands to the north, and rural lands to the east and south. The land was retained when the owner obtained consent to sever a lot containing a residence surplus to a farming operation. The new Provincial Policy Statement (2005) requires that new residential dwellings be prohibited on any vacant remnant parcel of farmland created by severance. The current zoning of the site permits residential uses. This non-conformity is being addressed through this Zoning Bylaw process.
DISCUSSION
Official Plan and Zoning Provisions
The site is designated Agricultural Resource
Area on Schedule A of the City Council Approved Official Plan and the former
Regional Official Plan. A key objective
of this designation is to protect lands suitable for agriculture from loss to
other uses. The former Township of Osgoode Official Plan designates this land
as Agricultural Resource, which intends to preserve this land for agricultural
uses. The site is currently zoned RU (Rural), which allows residential uses
under certain conditions. The site must be rezoned to conform to the new
Provincial Policy Statement.
Staff supports the proposed amendment because
it is consistent with the policies in the Official Plans and the Provincial
Policy Statement.
CONSULTATION
Notice of this application was
carried out in accordance with the City’s Public Notification and Consultation
Policy. The Ward Councillor is aware of
this application and the staff recommendation.
The City did not receive any negative comments or opposition to this
application.
This application was processed by the "On-Time
Decision Date" established for the processing of Zoning By-law Amendment
applications.
