REPORT RECOMMENDATION

 

That Emergency and Protective Services Committee recommend to Council that the minor amendments to Business Licensing By-law 2002-189, related to Second Hand Goods Shops, as outlined in Document 1, be approved.

BACKGROUND

 

Amalgamation of the twelve former municipalities in 2001 necessitated the harmonization of the by-laws in place in those municipalities.  Since amalgamation, Community and Protective Services’ By-law Services Branch has harmonized in excess of 300 former municipal by-laws. 

In addition to the harmonization process, it is common and best practice to periodically review and amend even new by-laws to ensure that they are technically correct and clear whilst maintaining Council’s original intent with respect to the by-law subject matter.

 

The Ottawa Police Service just recently brought to By-law Services’ attention that a section related to inspection powers, which was included in the Second Hand Goods By-law No. 100-98 of the former City of Ottawa, has been omitted in the harmonized by-law for that subject area. 

 

DISCUSSION

 

The purpose of the proposed amendment is to correct an omission from the sections of the harmonized Business Licensing By-law that relate to Second Hand Goods Shops and to correct a minor technical flaw.  Specifically, the proposed amending by-law, attached as Document 1, restores the inspection powers of Ottawa Police, and also corrects a minor typographical error.  The omission of that section relating to inspection powers of the Police, limits their abilities in this regard.

 

The proposed modifications do not impact on the intent of the by-law as originally approved and enacted by Council.

 

RURAL IMPLICATIONS

 

There are no rural implications associated with the recommendation.

 

CONSULTATION

 

Given the administrative nature of the recommendation, public consultation was limited to the mandatory placement of notices of public meeting in Le Droit, the Ottawa Citizen and the Ottawa Sun on March 17 and March 24, 2006.  The notices invite the public to provide comment on the proposal and to attend the April 13th, 2006 Emergency and Protective Services Committee meeting at which the report will be considered.  No comments related to the proposed amendment were received.

There are no financial implications associated with the recommendation.

DOCUMENT 1

 

BY-LAW NO. 2006-

 

                        A by-law of the City of Ottawa to amend By-law No. 2002-189 respecting licensing of second-hand goods shops.

 

                        The Council of the City of Ottawa enacts as follows:

 

1.                     Section 8 of By-law No. 2002-189 entitled “A by-law of the City of Ottawa respecting the licensing, regulating and governing of certain businesses”, as amended, is amended by adding the following subsection immediately after subsection (3a):

 

            8.         (3b)      The Chief of Police or the Chief License Inspector is hereby authorized to inspect:

(a)                as much of a place or premises as is used for the carrying on of the business of a second-hand goods shop, and

(b)               any goods, wares, merchandise, articles, books records or other documents of or relating to the second-hand goods shop.

 

2.                     Section 18 of Schedule No. 14, Relating to Second-Hand Goods Shops, of the said By-law No. 2002-189 is amended by striking out the number “3” where it occurs therein and substituting the number “30” therefor.
