COMMITTEE RECOMMENDATIONS

 

That Council:

 

1.                  Approve an amendment to Development Charges Bylaw 2004-310 adopted July 14, 2004 to reflect changes in the rates and the benefiting area for Gloucester East Urban Community resulting from changes to the Area Specific Development Charge Background Study dated June 28, 2004.

 

2.                  Approve the revised area-specific development charge for the Gloucester East Urban Community collection area, growth projections and rates listed in Document 3.

BACKGROUND

 

In 2004, the City enacted 15 Area Specific Development Charge By-laws for Individual Storm Water Management Ponds and Drainage Systems. Specifically, By-law 2004-310 of 2004 for charge area E-3, was passed for stormwater management ponds and drainage systems in the Gloucester East Urban Community. The development charge area known as area E-3 is generally bounded by Mer Bleue Road to the east, Innes Road to the north, the abandoned railway line to the south as well as Page Road and the National Capital Commission lands to the west. The development charge rates established in 2004 were set using the former Gloucester Council approved East Urban Community Orleans Expansion Secondary Development Concept Plan supporting Master Servicing Studies.

 

Subsequent to the passing of Development Charge By-Law 2004-310 for area E-3, the City undertook the preparation and ultimate approval of a Community Design Plan (CDP) for Phase 1 of the Gloucester East Urban Community (EUC). The CDP established land use distribution within Phase 1 as well as densities throughout both Phases of the community. Phase 2 of the CDP, which will primarily establish land use distribution, is being finalized concurrent with a subwatershed plan to address issues such as pond location. Densities have increased overall in the EUC in accordance with the 29 units per net hectare policies of the Official Plan. As such, the storm sewer infrastructure needs have also increased.

 

 

DISCUSSION

 

In 2005, the City approved the East Urban Community, Phase 1 Community Design Plan. As noted above, the net densities have been increased substantially in order to achieve the target densities of the new Official Plan.  The net densities have been established for the entire EUC through the approval of the Phase 1 CDP although land use distribution and other issues are still being reviewed for Phase 2.

 

In order to achieve the target densities of the new Official Plan, staff completed a detailed Master Servicing Study entitled Gloucester East Urban Community (EUC) Infrastructure Servicing Study Update, which analysed capacity of existing infrastructure as well as required infrastructure needs to support the increased densities. The Master Servicing Study dealt with the entire EUC area at a macro level and as such, the storm sewer infrastructure needs are known at this time. The Master Servicing Study was approved by the Planning and Environment Committee and Council concurrent with the Phase 1 CDP in 2005.

 

There are a number of developers who are advancing plans to construct residential subdivisions in the southwest quadrant of the EUC. It is expected that construction of the developer works could proceed in Spring of 2006. These developers will be required to adhere to the findings of the 2005 approved Master Servicing Study which identified the need to construct larger storm sewers (due the increased densities) than were originally envisaged in the previously approved Gloucester Concept Plan and Servicing Studies. Several of the storm sewers, which have been upsized to accommodate the increased densities, will meet the nominal size and flow criteria to be eligible for Development Charge funding; therefore, it is necessary to adjust the Development Charge rate in area E-3 to account for these additional costs. It is worth noting that, because these are Greenfield lands, the resultant increase in the Development Charge rate will not have a Benefit To Existing component or BTE and as such, there will be no budgetary impact on the City. Any increases will be made up exclusively through Development Charges. It should be noted that while there is an increase in cost in the overall storm related works, within the East Urban Community, those costs are now being distributed across higher unit densities thereby, keeping the resultant charge only slightly higher.

 

 

CONSULTATION

 

Given the increased densities and increase in stormwater infrastructure, an amendment to the bylaw is the required. An amendment to the Development Charge By-law requires consultation with the public.  The developers in the area are aware of this report and concur with it.  The public meeting will occur at the Corporate Services and Economic Development meeting of April 18, 2006. A notice of the proposed bylaw amendment was advertised in the Le Droit and the Citizen newspapers on April 7, 2006, and April 14, 2006. Copies of the amendment to the E‑3 Background Study information was made available to the public as of March 1, 2006.

 

 

FINANCIAL IMPLICATIONS

 

In the City of Ottawa Area-Specific Development Charge Background Study for Individual Stormwater Management Ponds and Drainage Systems, adopted by Council on July 14, 2004, the overall cost of Area E-3 projects totalled $17,180,000. Based on the 2004 anticipated land use within Area E-3, the residential and non-residential attributions were 58% ($9,905,000) residential and 42% ($7,274,000) non-residential. As a result of the increase in stormwater infrastructure, the revised total to Area E-3 is in the amount of $22,218,000 with a 63% allocation to Residential and a 37% allocation to non-residential. Netting out the existing reserve fund balance will result in an allocation of $12,594,000 residential, and an allocation of $7,337,000 to non-residential.

DISPOSITION

 

The report will be forwarded to City Council for a decision on April 26, 2006. Following the decision, any amendment to the By-Law will be advertised in the Citizen and LeDroit within 20 days. The public will have 40 days to appeal the amendment to the Ontario Municipal Board. Project Description

 

East Urban Community Gloucester Charge Area E-3

 

The Gloucester East Urban Community require the construction of three stormwater management ponds (ponds 1,2,and 3) and related trunk storm sewers. The above noted stormwater management ponds and trunk stormsewers are included within the E-3 benefiting charge area attached herein. East Urban Community stormwater management pond # 1 and related trunk storm sewers are located east of Page Road, north of the Hydro Electric Power Corridor. East Urban Community stormwater management pond # 2 and related trunk storm sewers are located southwest of the intersection of Renaud Road and Mer Bleue Road. East Urban Community stormwater management pond # 3 and related trunk storm sewers are located south of Renaud Road, north of the Mer Bleue Bog, and southwest of the intersection at Page Road and Fourth Line Road.

The Committee Coordinator advised of an error in the staff report on page 64, under Financial Implications.  The amount noted as the overall cost of Area E-3 projects was incorrectly stated as $12,343,000, when it is in fact $17,180,000.  With this correction, the Committee approved the item.
