That Council approve an amendment to the former City of Nepean Rural Zoning By-Law to change the zoning of 2761 Moodie Drive from Rural Agricultural Zone - Ru to Institutional Block "A" Zone - I Block "A"as shown in Document 1 and as detailed in Document 2.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

BACKGROUND

 

The purpose of this Zoning By-law amendment is to change the zoning of the subject lands from a Rural Agricultural Zone - Ru to an Institutional Block "A" Zone - I Block "A", to permit the development of a church and day nursery.

 

DISCUSSION

 

City Council Approved Official Plan and Former Regional Official Plan

 

On September 14, 2005 amendments were adopted to both the City Council Approved Official Plan and the Regional Official Plan for this site.  The purpose of the amendments were to permit the severance of a lot and development of the proposed institutional use within an Agricultural Resource Area.  As well, the amendment to the Regional Official Plan permitted the extension of a watermain a short distance into the rural area.

 

Details of Proposed Zoning

 

The proposed zoning for the site is Institutional Block "A" Zone - I Block "A".  This zone would permit the development of a church and associated day care facility and a lot area minimum of 0.8 hectares. 

 

This is in accordance with the review undertaken as part of the Official Plan amendment.  Staff recommends approval of this application.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

By-law 73-92 is amended by:

 

1.         Changing the zoning for 2761 Moodie Drive to an Institutional Block “A” Zone - I Block “A”

 

2.         adding the following to Section 8

 

a)         subsection 8:3 entitled "Exceptions to Section 8"; and

 

b)         clause 8:3 (a) to include a requirement for a minimum lot area of 0.8 hectares for lands located at 2761 Moodie Drive (part of Lot 20 Con 4 RF) and zoned I Block A.
