Committee recommendation

 

That Council approve an amendment to the former City of Gloucester Zoning By-Law to change the zoning of 5080 Albion Road from Me (Industrial Extraction Zone) to Me (Ex) (Industrial Extraction, exception x) as shown in Document 1 and as detailed in Document 2.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

BACKGROUND

[U2] 

The subject property is located on the southwest corner of Rideau and Albion Roads.  The 0.83‑hectare site currently contains a century old single dwelling, a detached garage, sheds and an unoccupied barn, as well as a pump house that also shelters a septic system. The surrounding area consists of vacant lands. It was retained for residential use when the owner obtained consent to sever and convey a larger portion of her property to an abutting landowner. The owner, who would like to use the site for residential purposes, has obtained consent to sever the property subject to the severed and the retained properties conforming to the Zoning By-law.

 

The current zoning does not permit a single family dwelling. This non-conformity is being addressed through this Zoning By-law process.

 

 

DISCUSSION

 

Official Plan and Zoning Provisions

 

The site is designated General Rural Area on Schedule A of the City Council Approved Official Plan and the former Regional Official Plan, which permit limited residential uses. The former City of Gloucester Official Plan designates the site as Limited Development, with a Mineral Resources Constraints overlay, which does not permit residential uses. However, these former Gloucester policies no longer apply as Schedule A of the City Council Approved Official Plan has been approved and its policies take precedence. The site is currently zoned Me, Industrial Extraction zone. This zone does not permit residential uses. The dwelling existed on the site at the date of passing of the Zoning By-law and subsequently was protected by zoning provisions for continuance of legal non-conforming uses. Now that the site of the house has been severed, it must be rezoned to recognize the existing use.

 

Staff supports the proposed amendment because it is consistent with the policies in the Official Plans. The existing single-family dwelling is in keeping with the general character of the area.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
