That Council approve an amendment to the former Township of Cumberland
Rural Zoning By-Law to change the zoning of 2667 Frank Kenny Road from
"Agriculture" (AGR) to "Agriculture - Exception 9"

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-Law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB. No delegations were present.

de zonage rural de l’ancien Canton de Cumberland afin de changer la désignation
de zonage du 2667, chemin Frank Kenny, de « Agriculture » (AGR) à « Agriculture
– exception 9 » (AGR-X9).
BACKGROUND
The subject property, 2667 Frank Kenny Road, is
located on the east side of the road between French Hill Road and Regimbald
Road. The parcel is situated in an agricultural
setting and is being used for this purpose at present. The site has frontages of 205.8 metres on
Frank Kenny Road and 300 metres on O’Toole Road and contains an area of 39.59
hectares. This Zoning By-law amendment
application has been made to fulfill a severance condition to sever a surplus
dwelling. There are no buildings on the
subject lands.
DISCUSSION
City Council Approved Official Plan
According to the City Council Approved Official
Plan, the subject land is designated “Agricultural Resource Area”. This designation is intended to protect the
major areas of agricultural production and other lands suitable for agriculture
from loss to other uses. It also ensures
that uses that would result in conflicts with agricultural operations are not
established in productive farming areas.
The Plan requires that where an application to sever a surplus dwelling
is made, the City will require that the vacant agricultural parcel so created
be rezoned to prohibit any residential use.
This housing restriction is intended to limit a pattern of lot creation
in Agricultural Resource Areas that would see a new residence being constructed
on a vacant farm property, the house being declared surplus and severed from a
lot and the pattern so repeated.
Former Regional Official Plan
The subject land is designated “Agricultural
Resource Area” in the former Regional Official Plan. This designation is intended to protect the major areas of
agricultural production and other lands suitable for agriculture from loss to
other uses. It also ensures that uses
that would result in conflicts with agricultural operations are not established
in productive farming areas.
Former
Cumberland Rural Official Plan
In to the Cumberland Rural Official Plan, the subject land is designated “Agricultural Resource Area”. This designation is intended to protect the major areas of agricultural production and other lands suitable for agriculture from loss to other uses. It also ensures that uses that would result in conflicts with agricultural operations are not established in productive farming areas.
Zoning
By-Law
According to the Rural Zoning By-law No. 64-82,
the subject land is zoned “AGR”. This
type of zoning requires a minimum lot area of 38 hectares for agricultural uses
and a minimum of 2000 m2 for “other uses” such as residential.
The applicant’s request to change the
agriculture zone to an agriculture zone that restricts residential use is
considered appropriate for the site.
The “AGR-X9” zone currently exists within the Cumberland Rural Zoning
By-Law and is used for this purpose.
This restriction will ensure consistency with the 2005 Provincial Policy
Statement and conformity with the Official Plan’s policies.
The subject land will be limited to
agricultural uses. By restricting
residential uses, major agricultural areas will be protected from fragmentation
and competing uses. In effect it will
enhance a rural heritage and fortify the rural landscape.
CONSULTATION
Notice of
this application was carried out in accordance with the City’s Public
Notification and Consultation Policy.
The Ward Councillor is aware of this application and the staff
recommendation. The City did not
receive any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
This application was processed by the "On Time
Decision Date" established for the processing of Zoning By-Law Amendment
applications.
