COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Kanata Zoning By-Law to change the zoning of 50 Lord Byng Way from RSC-2 Zone to RSC-2 - exception Zone to permit a paramedic facility, as detailed in Document 3.

Committee Chair Hume read a statement required under the Planning Act, wherein he advised that anyone who intends to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.  No delegations were present.

BACKGROUND

 

The City's Real Property Asset Management (RPAM) Branch, in conjunction with the Emergency and Protective Services Department, are endevouring to address the need of the Ottawa Paramedic Services program and accommodation plan within the Kanata area.  As part of this program, the development of a paramedic facility on the subject lands is required.

 


The site is located west of Kanata Avenue, between Kanata Avenue and the southern extension of Lord Byng Way.  The existing Holiday Inn Select site abuts the subject lands to the north.

 

The site is approximately 0.2 hectares in size and was subject to transitway development, however the design plans for the transitway concluded that the site is no longer needed for transitway purposes.  Accordingly, RPAM has now identified this site as an appropriate site for the proposed paramedic base.

 

DISCUSSION

 

The City of Ottawa Official Plan identifies certain land uses as "considered to be characteristic and supportive of the daily life and functioning of the community".  Considered a 'public use', a paramedic facility is permitted within all land-use designations, subject to all other applicable policies.

 

The lands are currently designated "Mixed Use Centre" in the City Council Approved Official Plan and "RSC-2" - Regional Shopping Centre Type 2 within the former City of Kanata Official Plan.  The current "Mixed Use Centre" designation policies do not exclude the proposed use, nor does the use conflict with any of the relevant applicable Official Plan policies.

 

Zoning By-Law 78-96 lists a 'public use as a permitted use within the RSC-2 Zone, however all non-residential uses within the RSC-2 Zone are only permitted if located within a defined Shopping Centre or on the ground floor of either a residential or office building.  The purpose of the application is to permit the development of a free-standing paramedic facility.  The preferred option is not to locate the use within an existing or proposed building that is not under City ownership.  RPAM concludes that as a City operated and managed facility, sole ownership and operation is required to facilitate the proposed development.

 

Compatibility with the existing and future development in the area has been considered.  The paramedic facility will have direct access to the future transitway, signalized access to Kanata Avenue off Lord Byng Way and convenient access to Highway 417 from the Castlefrank Overpass (see Document 4).  There has been no objection or comments of concern brought forth by the abutting landowners or present tenants within the 'City Walk' and 'Kanata Centrum' Regional Shopping Centre site.  Mitigation measures are being investigated and could be incorporated into the proposed development should noise levels of the paramedic base become a concern for the directly abutting Holiday Inn Select hotel site.  Any mitigation will be addressed once formal Site Plan Control application has been submitted.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. Information signs were posted on-site indicating the nature of the application.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

By-law Number 2004-XX of the City of Ottawa amends By-law 78-96, being a Zoning By-law to regulate the use of lands and character, location and use of buildings and structures in the former City of Kanata, for the purpose of permitting a paramedic facility within a free-standing building at the property municipally described as 50 Lord Byng Way.

 

Amending By-law 2004-XX changes the current Regional Shopping Centre Type 2 "RSC-2" Zone to a Regional Shopping Centre Type 2 - exception Zone for 50 Lord Byng Way, by adding the new exception provision that will permit the 'public use'; non-residential use to be developed within a free-standing structure, as opposed to being developed within a Shopping Centre or the ground floor of a residential or office building.

 


DETAILS OF RECOMMENDED ZONING                                                              Document 3

 

1.         Add a new subsection, as follows:

 

                     8.3         EXCEPTIONS TO THE RSC-2 ZONE

All lands zoned under this subsection must comply with Section 8.1 and Section 8.2, with exception to the following:

 

(a)                 RSC-2A ZONE

 

(i)                  Notwithstanding the development requirements of Section 8.1(b) a paramedic/ambulance base is permitted as a main use within a freestanding building.

 

2.         Rezone the property municipally described as 50 Lord Byng Way from RSC-2 to RSC-2A Zone.
