COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Kanata Zoning By-Law No. 74-79 to repeal the zoning of a portion of  1150 Old Carp Road, and an amendment to the former City of Kanata Zoning By-law 161-93 to include these lands within By-law 161-93 and to zone them Residential Type 3A (R3A) as detailed in Document 1.

BACKGROUND

 

The subject lands form part of what is known as "the Bidgood Property" which is bounded by an urban subdivision know as Morgan's Grant Phase 12.  A consent to sever application regarding these lands was approved by the Committee of Adjustment on February 26, 2004. Its purpose was to sever and convey a portion of the Bidgood lands to Minto Developments Inc.  The exchange provides adequate lot depth for the development of fourteen single family homes at this location.  The Bidgood lands are currently zoned Estate Residential (ER) in By-law 74-79.  The adjacent Minto property to which the severed lands will be added are zoned Residential Type 3A (R3A).

 

DISCUSSION

 

The Council Approved Official Plan designates the lands as General Urban Area.  This designation allows for all types and densities of housing including fully-detached dwellings.

 

The former Regional Official Plan also designates the lands as General Urban Area.  This designation is to be used primarily for residential purposes along with the services and community facilities required to meet day-to-day needs.

 

The lands are designated "Low Density Residential" and "Open Space" through the former City of Kanata Official Plan Amendment No. 58 (LOPA 58).  Permitted uses within the Residential designation include fully-detached, semi-detached and multiple-attached dwelling units..

 

The property is currently zoned ER by the March Rural Zoning By-law (74-79).  Permitted uses in this zone include fully-detached units and various agricultural uses.  Although residential uses are permitted under the current zoning, the provisions and standards pertain to developments within a rural setting.  The proposed amendment reflects that these lands are now within the urban area of the city and will be developed on full municipal services.  In particular, the R3A allows for a variety of residential uses including fully-detached dwellings.  The applicant has already received draft plan approval for a plan of subdivision on the lands currently zoned R3A.  The approval would have to be amended to reflect the Bidgood Lands.  They are to be developed into 14 fully-detached dwellings.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy. Information signs were posted on-site indicating the nature of the application.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

By-law Number 2004-XX amends Zoning By-law Number 74-79 and Zoning By-law Number 161-93 of the former City of Kanata.  This amendment affects the property at 1150 Old Carp Road.

 

The site is within the western portion of the South March Community and forms part of a residential development known as Morgan's Grant.  The Regional Official Plan designation of these lands is "General Urban Area".  This designation is to be used primarily for residential purposes along with the services and community facilities required to meet day-to-day needs.  The Council Approved Official Plan designates the lands as General Urban Area.  This designation allows for all types and densities of housing including fully-detached dwellings. The lands are designated "Low Density Residential" and "Open Space" through Local Official Plan Amendment No. 58 (LOPA 58).  Permitted uses within the Residential designation include fully detached, semi-detached and multiply attached dwelling units.   The Official Plan amendment recognized that the lands had been brought into the urban area and revised the Residential and Open Space designations.

 

On November 28, 2003, an application was received the the City of Ottawa to rezone these lands from Estate Residential (ER), to Residential Type 3A (R3A).  It is a condition of severance approval that was granted to Mrs. M. Bidgood on February 26, 2004.  The purpose of the severance application was to provide adequate lot depth to 14 lots that abut to the south (Minto Developments Inc.)

 

The current ER zone on the property under Zoning By-law Number 74-79 will be repealed through this rezoning. It would then amend Zoning By-law Number 161-93 by including these lands within the limits of the by-law's boundaries and by zoning them R3A.

Chair Hume began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

Rod Price, Minto Developments Inc., was present in support of the recommendation contained in departmental report dated 30 March 2004.  The Committee approved the recommendation.
