COMMITTEE RECOMMENDATION

 

That Council approve an amendment to the former City of Gloucester Zoning By-Law to lift the Holding designation from a series of single dwelling lots located at the north-east corner of Spratt Road and Canyon Walk Drive, to permit the development of the lots, as shown in Document 1.

BACKGROUND

 

The subject property is a series of single dwelling lots located at the north-east corner of Canyon Walk Drive and Spratt Road.

 

A report was brought forward to the Planning and Development Committee meeting of June 12, 2001 to lift the holding designation from three subdivision phases of the development.  Unfortunately, at the time a mapping error left out 13 lots from the lifting of the holding zone.  These lots are an integral part of the overall subdivision now registered as Plan 4M-1144.  The purpose and intent of the previous report was to lift the holding designation from the entire land area of 4M-1144 and was never meant to leave out these lots.  The Owner is now prepared to build on these lots and the holding designation needs to be lifted before full approvals can be issued.

 

Purpose of Zoning Amendment

 

The purpose of this amendment is to lift the holding from the 13 lots and therefore permit the development of these lots.

 

Existing Zoning

 

The existing zoning is HRc3, Holding Special Mixed Residential Dwellings zone.  The base Rc3 zone is the one used throughout Riverside South.  It permits singles, semi-detached and street row dwellings at an overall density of 25 units per hectare. 

 

Proposed Zoning

 

The proposal is to lift the Holding designation resulting in the 13 lots being zoned Rc3.

 

 

CONSULTATION

 

Lifting of Holding Zone applications are not subject to the City's Public Notification and Consultation System. The Ward Councillor is aware of this application and the staff recommendation.  This type of application is delegated to staff; the Ward Councillor lifted delegated authority and the matter will be considered by Planning and Development Committee and City Council.

 

Notice of intent to pass a by-law to lift the holding zone will be given in accordance with City procedures.

Chair Hunter began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

The Committee approved the recommendation contained in departmental report dated 30 October 2003.
