That the Planning and
Development Committee recommend Council approve an amendment to the former City
of Cumberland Rural Zoning By-Law to change the zoning of 3184 Frank Kenny Road
from Agriculture - AGR to Agriculture - Exception Nine AGR-X9 to remove as a
permitted use a single detached dwelling as detailed in Document 2.

BACKGROUND
The affected property is
located north-east of the village of Navan along the west side of Frank Kenny
Road near the intersection of Giroux Road.
These farmlands, on parts of the east halves of Lots 7 and 8, Concession
8, have been subject to a consent application (D-08-01-03/B-00398) which results in the severance of the bulk
of the property, a parcel of approximately 53.8 hectares, from the retained
parcel of about 2.7 hectares. On the
latter parcel is located an existing house and accessory buildings. The severed lands are being acquired for use
by another farm operation.
This Zoning By-law amendment
is needed to fulfill a condition of approval of the aforementioned consent
application wherein no new permanent residential uses are to be allowed on the
severed vacant farm parcel.
The zoning of the affected
lands is Agriculture - AGR with a narrow Floodplain - FP zone overlay
traversing portions of the lands.
Proposed Zoning
The zoning would be changed
to the Agriculture - Exception 9 (AGR-X9) zone, an existing exception zone,
which permits all uses in the Agricultural AGR zone except for the use single
detached dwelling. The Floodplain - FP
overlay rezoning will remain.
DISCUSSION
The former Regional Official
Plan and the Rural Official Plan of the former City of Cumberland both
designate the lands as Agricultural Resource Area. The Cumberland Plan requires that when there is a consolidation
of farmlands and a dwelling situated on such lands is declared to be surplus
and severed off on its own lot, the remnant vacant agricultural parcel is to be
rezoned to prohibit any residential use.
The City Council Approved
Official Plan also designates the lands as Agricultural Resource Area and
maintains the Cumberland prohibition with the explanation of: "This housing restriction is intended
to limit a pattern of lot creation in Agricultural Resource Areas that would
see a new residence being constructed on a vacant farm property, the house
being declared surplus and severed from a lot and the pattern so
repeated." One of the best ways of
preserving areas of good soil for farming is to limit the severance of lots or
establishment of new uses that may conflict with agriculture - in particular
new houses not related to farming.
The proposed Zoning By-law
amendment would zone the lands to the Agricultural - Exception 9 zone which
prohibits a "single detached dwelling" but allows all other uses in
the Agricultural - AGR zone. The new zoning
would restrict the purchaser of the vacant farm land from building a new single
detached house on the lot.
CONSULTATION
Notice of this application was carried out in accordance with the
City's Public Notification and Consultation Policy. Information signs were
posted on-site indicating the nature of the application. The Ward Councillor is aware of this
application. The City did not receive
any negative comments or opposition to this application.
FINANCIAL IMPLICATIONS
N/A
The application was not
processed within the timeframe established for the processing of Zoning By-Law
amendments due to the need to await the decision of the Committee of Adjustment
on the related consent application, before proceeding with the rezoning
application.

began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this
proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must
either voice their objections at the public meeting, or submit their comments
in writing prior to the amendment being adopted by City Council. Failure to do
so could result in refusal/dismissal of the appeal by the OMB.
The Committee approved
the recommendation contained in departmental report dated 30 October 2003.
