That Council approve an amendment to the former Township of Rideau Zoning By-law, to change the zoning of 5935 McCordick Road from A2-44 - General Rural Special Zone 44 to RE-26 - Estate Residential Special Zone 26 as shown in Document 1.

BACKGROUND

 

The purpose of the proposed Zoning By-law amendment is to facilitate the severance of a parcel of land located on McCordick Road in the former Township of Rideau.  This application has been filed by the landowner in response to a condition imposed by the Committee of Adjustment.

The approval of the consents to divide the property into two parcels requires a Zoning By-law amendment on the severed property in order to ensure conformity with the provisions of the former Township of Rideau Zoning By-law 84-77.

 

 

DISCUSSION

 

The subject property is designated “Agricultural Resource Area” in the City Council approved Official Plan and “Agricultural Resource Area” in the former Regional Official Plan.  The former Rideau Official Plan designates the land as “Agricultural Resource”.  The lands are further zoned “A2-44 - General Rural Special Zone 44” in the former Township Zoning By-law.

 

The severance was approved under Section 7.4 of the Regional Official Plan as an area of poor land.  Soil mapping indicates that the land is predominately organic soil that is not suitable for farming. 

 

As a result of the approved poor pocket severance, a 2-hectare lot with 85.6 metres of frontage along McCordick Road was created.  The proposed rezoning will amend the zoning on the severed parcel from “A2-44  – General Rural Special Zone 44” to “RE-26 - Estate Residential Special Zone 26”.  This will bring the newly created lot into conformity with regards to lot area in the Township of Rideau By-law 84-77.

 

The retained parcel is currently zoned “A2-44 - General Rural Special Zone 44” and will not require any further amendments to conform to the Zoning By-law.

 

 

RURAL IMPLICATIONS

 

The introduction of residential uses on the existing landscape is viewed as negligible.

 

 

CONSULTATION

 

On site information signs were posted indicating the nature of the application.  Selected review agencies were also circulated for comment.  No substantive comments were received.

 

The Ward Councillor is aware of the application.

The application was processed within the timeframe established for the processing of Zoning By-law amendments.

Chair Hunter began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council.  Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

The Committee approved the recommendation contained in departmental report dated
4 July 2003.
