Committee Recommendations
That Council:
1. Declare
a vacant parcel of land approximately 171.4 m2 in area, subject to a
legal survey, described as Part of Lot 18, Junction Gore, City of Ottawa, shown
hatched on Annex “A”, as surplus to the City’s needs;
2. Approve
the sale of the land described in Recommendation 1, subject to easements to the
City of Ottawa, Bell Canada and Hydro Ottawa, to Brian H. R. Johnstone, for the
sum of $4,690.00, plus GST, pursuant to an Agreement of Purchase and Sale that
has been received.

approximative de 171.4 m2 constituant une partie du lot 18,

ci-annexé;
2. Approuve la vente du terrain décrit à la recommandation 1, sous réserve des
servitudes requises, à Brian H. R. Johnstone, moyennant la somme de
4,690 $ plus TPS, conformément à une convention de vente qui a été reçue.

The subject lands were
acquired by the former City of Ottawa to construct the sewer connection from
Riverside Drive to Chalmers Road and were incorporated with the property owned
by the City for the existing pedestrian pathway from Riverside Drive to the
Billings Estate.
Mr. Johnstone contacted City
staff in 1999 to inquire if he could purchase a portion of the City-owned
property that abuts his property at 2136 Chalmers Road. His intent was to acquire and landscape the
171.4 m2 parcel of land immediately
west of his property.
DISCUSSION
As a result of Mr. Johnstone’s
interest, a circulation was undertaken to all City Departments, outside
agencies and utility companies to determine if there was a mandate to retain
this property in City ownership or whether it could be declared surplus and
sold.
The Department of
Transportation, Utilities and Public Works indicated that the land was not
required for future works but an easement back to the City would be required
for the existing underground plants.
Community Services confirmed that the disposal of the 171.4 m2 parcel of land would not interfere with the current or future
pedestrian/bicycle pathway system for the area.
The zoning on the
City’s land is ES1 and L1B. The ES1
zone denotes “Environmentally Sensitive Area”.
No buildings, parking or any other uses are permitted in the ES1
zone. The L1B zone is “Major Open Space
Zone”. Its purpose is to limit the
range and intensity of leisure and recreational uses on lands with this
designation. The intended use of the
property (landscaping) is in keeping with the zoning. The final property limits and conveyance is subject to the
completion of a legal survey and registration of a reference plan. The sale is subject to any easements that
may be required. The offer is
considered fair and reasonable and is recommended for acceptance.
CONSULTATION
In accordance with policies
approved by City Council on 14 November 2001, the availability of the property
was circulated to all client City Departments, including the Housing Branch, to
determine if it should be retained for a City mandated program. Neither the Housing Branch nor any other
City Department expressed interest in retaining the property. Local governments and external agencies were
also circulated, but none expressed interest in acquiring the property. The Development Services Department is aware
of the proposal and supports the sale of the City’s parcel. The Ward Councillor has been made aware of
the proposed sale of the property, and is in support of staff’s recommendation.
FINANCIAL IMPLICATIONS
This transaction represents
revenue of $4,690.00 to the City and will be credited to Profit Centre
119909-407217 (Surplus Land Sales).
