BACKGROUND
The applicant, Urbandale Realty, has requested to change the street name “Nelligan Lane” to “Rivergate Way” in support of their new commercial development located on the south-east corner of Nelligan and Riverside Drive. Urbandale requested assistance from the Department to improve way finding for the new project which fronts onto Riverside Drive but, without direct access onto Riverside Drive, had a municipal address on Nelligan Lane.
As it happens, this roadway also links Riverside Drive to Old Riverside Drive, which would provide the Department an opportunity to eliminate a street name anomaly, as identified by Emergency Services during the Duplicate Street Naming project.
DISCUSSION
Nelligan Lane
Currently there are no residents or businesses located adjacent to Nelligan Lane. The one subordinate address associated with this street relates to a secondary address for the Urbandale project. The subject property was once the location of the Nelligan family apple farm.
There are three sections of roadway in close proximity that incorporates the name “Riverside Drive.” Specifically, the new realigned Riverside Drive between Industrial Avenue and River Road, a section of old Riverside Drive located north of Smyth Road (east of the realigned roadway), and the subject roadway located just north of the Hunt Club Road (west of the realigned Riverside Drive). The objective, as identified in the review of this anomaly, is to change the name of the two shorter sections.
A proposal has been received to rename the section of the former Riverside Drive adjacent to Smyth Road to “Lycée Claudel”. The current application to rename “Nelligan Lane” presents a unique opportunity to eliminate potential confusion by renaming both “Nelligan Lane” and the second section, “Old Riverside Drive”. It is recommended the full length of the combined roadway be assigned the new name “Rivergate Way.”
CONSULTATION
Written notification was provided to the owners/tenants on Old Riverside Drive and to area Community Groups. One objection was received from an affected resident. The comment stressed that none of the residents have had an incident related to an emergency service not finding their homes. Further, that a unique street name should not be changed at the behest of a developer.
While, to date, there may not have been an emergency leading to confusion in way finding for Old Riverside, the Duplicate Naming project was undertaken specifically to address this kind of anomaly. The objective is to avoid potential confusion resulting in emergency services attending the wrong address and a delay in the critical response time.
The legislated notification in the local French and English newspapers having general circulation has been provided.
The cost related to new street signs is the responsibility of the applicant and the City within the funding envelope for Duplicate Street Names account. Consistent with the policy of the Corporation, affected residents and businesses will not be compensated for costs related to the name change. Enactment of the by-law will be delayed 3 months to provide time to exhaust stationery and notify personal and business contacts.

DISPOSITION
1. Development Services Department is responsible to notify the owners and tenants on Old Riverside Drive, and appropriate emergency/technical agencies.
2. Legal Services Branch of Corporate Services Department to finalize the draft by-law and forward the by-law the City Council for enactment.
3. Traffic and Parking Operations Branch of Transportation, Utilities and Public Works Department is responsible to arrange for the manufacture and installation of required street signs on request.

BY-LAW NO. 2003 –
A by-law of the City of Ottawa to change the name of a certain municipal highway in the City of Ottawa (Old City of Ottawa – Ward 16 - River).
WHEREAS the Council of the City of Ottawa desires to assign new names to two existing municipal highways in the City of Ottawa;
AND WHEREAS Section 47 of the Municipal Act, 2001, S.O. 2001, c. 25 provides for the naming of highways.
THEREFORE the Council of the City of Ottawa enacts as follows:
1. That the street names listed herein be accepted and assigned to the municipal highway and portions thereof, being more particularly described in Schedule “A”, attached:
Rivergate Way.
2. That the by-law will come into full force and effect on July 9, 2003.
