That Council approve an amendment to Zoning By-law 84-77 of the former Township of Rideau, to change the zoning of 3155, 3145, 3135 and 3125 Paden Road from A2-General Rural to RE-Estate Residential, from A2-General Rural to EP-Environmental Protection and from A2-General Rural to A2-47 General Rural Exception 47 as shown in Document 2.

BACKGROUND

 

The purpose of the proposed Zoning By-law amendment is to permit the severance of a parcel of land located on Paden Road in the former Township of Rideau.  This application has been filed by the landowners in response to a condition imposed by the Committee of Adjustment.

 

The approval of the consents for the creation of four non-farm related residential lots generates a need to rezone the subject properties in order to ensure conformity with the provisions of the Comprehensive Zoning By-law 84-77.

 

DISCUSSION

 

The subject property is designated “General Rural Area, Organic Soils and Provincially Significant Wetland” in the former Regional Official Plan.  The Rideau Official Plan designates the land as “Marginal Resource and Natural Environment”.  The lands are further zoned “A2-General Rural” in the Township Zoning By-law.

 

As a result of the approved severance, four lots of equal area (1.65 ha.) and frontage (67.57 m.) were created.  The proposed rezoning to RE-Estate Residential will bring the newly created lots into conformity with the Township of Rideau By-law 84-77.  In addition, the wetland feature located on three of the lots will be rezoned to EP-Environmental Protection.

 

The remnant parcel will have an area of approximately 53 ha. and 67.5 m. of frontage.  The lands are currently zoned “A2-General Rural” and require a minimum lot area of 35 ha. and a minimum lot frontage of 150 m.  For the purpose of this zoning amendment these lands will be rezoned to A2-47 General Rural Exception 47 (see Document 2).  The exception to this by-law will address the deficiency in lot frontage.

 

ENVIRONMENTAL IMPLICATIONS

 

The Conservation Authority have not identified any natural environmental issues which would prevent this zoning amendment.  A Geotechnical  Evaluation Report to address organic soils was prepared by the applicant to the satisfaction of the Conservation Authority.  The wetland feature will be secured by means of placing the lands in an Environmental Protection Zone.  

 

RURAL IMPLICATIONS

 

The introduction of residential uses on the existing landscape is viewed as negligible.

 

CONSULTATION

 

On site information signs were posted indicating the nature of the application.  Selected review agencies were also circulated for comment.  No substantive comments were received.

 

The Ward Councillor is aware of the application and has no objections to its approval.

 

FINANCIAL IMPLICATIONS

APPLICATION PROCESS TIMELINE STATUS

 

The application was not processed within the timeframe established for the processing of Zoning By-law amendments due to Conservation Authority concerns related to soil conditions.

Chair Hunter began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council. Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

The Committee approved the recommendations contained in departmental report dated 24 January 2003.  An e-mail dated 12 February 2003, from Bill Royds, Co-Chair, Greenspace Alliance of Canada’s Capital, was circulated and on file with the City Clerk.
