That the Transportation and
Transit Committee recommend Council approve the following waivers to the former
City of Ottawa Private Approach By-Law 170-73:
1.
Section 13 (a) to permit three (3) two-way accesses on
Lancaster Road where the frontage permits only two (2) to be located;
2. Section
13 (j) to permit a distance between a private approach and the nearest
intersecting street line to be 118 feet (36.0 metres) where it is required to
be no less than 150 feet (45.7 metres).
Que le Comité des transports et des services de
transport en commun recommande au Conseil d’approuver des dérogations aux
paragraphes suivants du Règlement municipal 170-73 sur les accès privés de
l’ancienne Ville d’Ottawa :
1.
le
paragraphe 13(a), afin de permettre trois (3) accès bidirectionnels sur le
chemin Lancaster, alors que la façade n’en permet que deux (2);
2.
le
paragraphe 13(j), afin de permettre que la distance entre un accès privé et le
bord de l’intersection la plus proche soit de 118 pieds (36 mètres), alors
qu’elle ne doit pas être inférieure à 150 pieds (45,7 mètres).
The proposed development for 2780-2810 Lancaster Road includes the construction of two commercial buildings, a restaurant, and a fast-food restaurant. The total development provides 126 surface parking spaces. The total frontage along Lancaster Road is approximately 617.8 feet (188.3 metres). Document 2 shows the location of the proposed access points, with Access 1 functioning as a right-in/right-out access. Existing sidewalks on the Lancaster and Walkley Road frontages of the property will remain in place.
Section 13 (a)(iv) of the former City of Ottawa Private Approach By-Law 170-73 provides that only two (2) two-way private approaches may be permitted for properties with a frontage between 150 feet (45.7 metres) and 500 feet (152.4 metres). Section 13 (a)(v) allows for one additional two-way private approach for each additional 250 feet (76.2 metres).
Section 13 (j) further provides that the minimum distance between a private approach and the nearest intersecting street line shall be no less than 150 feet (45.7 metres). The separation distance between Access 1 and Walkley Road is only 118 feet (36.0 metres).
Accordingly, the applicant has applied for relief from the by-law to permit the construction of these approaches.
Proposed is the construction of three two-way accesses. Access 3 would primarily service Building “D”, while Access 1 and Access 2 would serve the restaurants and Building “C”. Access 1 would only provide access to and from the southbound lanes of Lancaster Road (as enforced by the extension of an existing median). These access points will reduce the queuing on Lancaster Road and therefore result in an improved intersection at Walkley and Lancaster.
Staff have reviewed the submitted plans and inspected this location and noted that:
It is the opinion of this Department that the construction of the third two-way private approach at 2780-2810 Lancaster will not create any vehicular or pedestrian safety hazards.
No public consultation on the proposal application has taken place. The Development Services Department is supportive of the proposed waiver for this development. Ward Councillor Peter Hume is aware and supportive of this application.

Councillor Legendre thought that two accesses were sufficient for this development and while an additional access might make it easier for motorists, it creates an additional crossing for pedestrians. He could not support the proposal.
Richard Hewitt, Director of Infrastructure Services, advised that pedestrian volumes in the area are relatively low and that site plan approval has already been granted under delegated authority, subject to committee and Council’s approval of this access. He explained that staff do not object to the addition of the third access under the terms that have been presented, but noted that from the external circulation perspective, the Department feels that two accesses are just as preferable. It was felt that by dividing the center-most access into two and having the southern most of those being right-in/right-out only, the potential problems will be divided with regard to internal circulation. Mr. Hewitt further added that while it is possible to meet the terms of the by-law with two accesses, particularly by moving the southern-most access further north and potentially limit the turning movements onto the street by extending the median even further, complications arise on the other side of the street where there are accesses for other developments.
