Committee Recommendation
That Council approve:
The General
Manager of Transportation, Utilities and Public Works be instructed to issue a
temporary encroachment permit to allow an outdoor patio within the Beechwood
Avenue and the Putman Avenue road allowances at 143 Putman Avenue, to be
reviewed on a yearly basis and renewed subject to no complaints from the
community regarding this operation and subject to the same conditions which are
applied to all outdoor patios for which temporary encroachment permits are
issued, in addition to the following conditions:
1. That this outdoor
patio shall be required to close at 10:00 p.m.;
2.
That the General Manager of
Transportation, Utilities and Public Works report to the Transportation and
Transit Committee if any noise related complaints are received regarding the
operation of this outdoor patio; and
3.
That in the event that the
permit is revoked or not renewed, the owner be required to reinstate the
portion of the public property occupied by the patio to the satisfaction of the
General Manager of Transportation, Utilities and Public Works.

De demander à la directrice générale
des Transports, Services et Travaux publics d’émettre un permis d’empiètement
temporaire afin de permettre une terrasse extérieure sur la réserve routière de
la rue Beechwood au 143, avenue Putman, lequel permis sera examiné annuellement
et renouvelé sous réserve qu’aucune plainte ne soit déposée par la communauté
quant à son exploitation et des mêmes conditions s’appliquant à toutes les
terrasses extérieures pour lesquelles un permis d’empiètement temporaire est
émis ainsi que des conditions suivantes :
1.
que
ladite terrasse extérieure soit tenue d’être fermée à 22 h 00;
2.
que
la directrice générale des Transports, Services et Travaux publics avertisse le
Comité des transports et des services de transports en commun si une plainte
relative au bruit est reçue concernant l’exploitation de ladite terrasse
extérieure; et
3. qu’au cas où ledit permis serait annulé
ou ne serait pas renouvelé, le propriétaire soit tenu de restituer la portion
de propriété publique occupée par la terrasse à la satisfaction de la
directrice générale des Transports, Services et Travaux publics

That the Transportation and

RECOMMANDATIONS DU RAPPORT
Que le Comité des transports et des services de
transport en commun recommande au Conseil municipal de demander à la directrice
générale des Transports, Services et Travaux publics d’émettre un permis
d’empiètement temporaire afin de permettre une terrasse extérieure sur la
réserve routière des avenues Beechwood et Putman, au 143, avenue Putman, lequel
permis sera examiné annuellement et renouvelé sous réserve qu’aucune plainte ne
soit déposée par la communauté quant à son exploitation et des mêmes conditions

The municipal councillor, Jacques Legendre, as well as the immediate community support the seasonal summer patio that the Works Gourmet Burger Bistro would like to open at 143 Putman Avenue. The petition entitled “The Works – Seasonal Patio Support” circulated in the neighbourhood was signed by 261 individuals. Of these 261 supporters many are residents of the adjacent streets (Beechwood, Acacia, Putman and Chapleau Avenues) who are more than likely to be affected by the operation of this patio.

The Encroachment By-Law provides a square footage charge of $0.085 . It
is estimated that the encroachment permit fee for this proposed patio would be
$3,000 for a 5-month season.
Subject to the conditions noted, staff will issue a
temporary encroachment permit, to be reviewed on a yearly basis.
