That the Planning and Development Committee recommend Council approve an amendment to the former City of Ottawa Zoning By-law 1998 to change the zoning of 705-713 Montreal Road, from L3[698] – Community Leisure Zone to an I2 F(1.5) – Major Institutional Zone.

BACKGROUND

 

Site Location:

 

The land affected by this amendment is approximately 55 metres wide by 300 metres long located at the rear of the Montfort Hospital site.

 

Description of Site and Surroundings:

 

Lang's Road is situated to the east, the Montfort Woods to the north and the Aviation Parkway to the west.  A long-term care facility recently has been built on the westerly portion of the land, while the remaining portion is vacant or utilized for parking.

 

Purpose of Zoning By-law Amendment Proposal:

 

The purpose of the zoning proposal is to extend the existing Institutional zoning of the Montfort Hospital across the entire Hospital's landholding, including the land affected by this amendment.

 

Proposal Details:

The current zoning of the affected land is L3[698].  The L3 zone is a Community Leisure Zone permitting a community centre, park, recreational and athletic facility, sports arena etc.  The [698] exception permits a range of additional uses, such as dwelling units for elderly persons, place of worship, school, college or university etc.  The proposed new zone designation would be identical to the zoning on the Montfort Hospital site, which is an I2 F(1.5) zone.  The I2 - Major Institutional Zone permits large-scale institutions (hospital, museum), minor institutional uses (retirement home, library) and provides for a range of ancillary uses (parking garage).  The (1.5) floor space index indicates that gross floor area of buildings on the site cannot exceed one and a half times the lot area.

 

DISCUSSION

 

The Department is recommending approval of the application.  Prior to the passage of the former City of Ottawa’s Comprehensive Zoning By-law 1998, the Montfort Hospital site and the abutting lands to the north, known as the Montfort Woods, were zoned “P” – a Public Use designation.  The Montfort Woods site, at that time, was owned by Les Filles de la Sagesse d’Ontario.  The introduction of a separate and distinct Major Institutional Zone designation within Zoning By-law 1998, as it applied to major institutional uses, resulted in the zone designation of the Montfort Hospital property changing from P to I2  F(1.5).  The new zoning was intended to include the entire Hospital’s landholding.  The Hospital zoning boundaries were determined by plans submitted to staff at the time of the Zoning By-law review.  It now has been determined that the affected parcel of land, which is owned by the Hospital, was inadvertently zoned to a non-institutional zoning, L3[698], the same designation as the Montfort Woods.  The purpose of this amendment is to correct this anomaly in the Zoning By-law, thereby extending the current I2 F(1.5) Hospital zoning across all lands within the ownership of the Montfort Hospital.

 

ENVIRONMENTAL IMPLICATIONS

 

An Environmental Impact Checklist was completed by the applicant that identified no environmental impacts.

CONSULTATION

 

The application was subject to Early Notification and the posting of on-site information signs.  Two e-mail comments were received which had concern regarding the nature of the amendment.  This concern is described in Document 4.   The Ward Councillor, Jacques Legendre, is aware of and supports the application.

 

FINANCIAL IMPLICATIONS

APPLICATION PROCESS TIMELINE STATUS

 

The application, which was submitted on January 22, 2002, was subject to a project management timeline.  A Mandatory Information Exchange to the affected community groups was not undertaken as the applicant undertook pre-consultation.

 

The application was processed within the timeframe established for the processing of Zoning Amendment applications.

THE FOLLOWING IS AN EXPLANATORY NOTE TO BY-LAW NUMBER .......

 

By-law Number ........... amends Zoning By-law, 1998, the former City of Ottawa’s Comprehensive Zoning By-law.  This amendment affects a parcel of land owned by the Montfort Hospital that is approximately 55 metes wide by 300 metres long located at the rear of the Hospital and running parallel to Montreal Road, as shown on the attached location map.

 

The purpose of the amendment is to extend the existing Institutional zoning of the Montfort Hospital across the entire Hospital property.

 

Current Zoning

NOTIFICATION AND CONSULATION PROCESS

 

Notification and consultation procedures were carried out in accordance with the notification and consultation procedures approved by City Council for Zoning Amendments.

 

PUBLIC COMMENTS

 

Two comments were received.  One comment confirmed the name of the President of the adjacent Fairhaven Way Cooperative Inc. while the other expressed concern about whether this amendment was actually needed after the area had recently seen the submission of several zoning applications and amendments to the Zoning By-law.  The comment further mentioned that the proposed amendment did not warrant immediate consideration as the current L3 zoning was not appealed by the Hospital when Zoning By-law 1998 came into effect and, therefore, the L3 zone should be deemed valid and binding for the future.  The letter recommended that all zoning requests be deferred and consolidated into a single Secondary Policy Plan Study for the entire area.

 

Response:

 

Staff acknowledges that there has been on-going zoning activity in this area, but the purpose of the current application is to correct an anomaly in Zoning By-law 1998.  As mentioned above, the entire Montfort Hospital site was not rezoned Institutional after the passage of Zoning By-law 1998.  The land affected by this amendment, although owned by the Hospital, was inadvertently zone non-institutional.  The present application will place all the Hospital’s landholding under one I2 F(1.5) zone designation.

 

COUNCILLOR’S COMMENTS

 

Councillor Jacques Legendre is aware of and supports the application.

Chair Hunter began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council.  Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

Kathleen Willis was present representing the Montfort Hospital and satisfied with the departmental recommendation contained in the Report dated 10 April 2002

 

That the Planning and Development Committee recommend Council approve an amendment to the former City of Ottawa Zoning By-law 1998 to change the zoning of 705-713 Montreal Road, from L3[698] – Community Leisure Zone to an I2 F(1.5) – Major Institutional Zone.
