The Mayor, Bob Chiarelli, presided and led Council in prayer.

Recognition – Dinqinesh Record of Honour
In recognition
of his support in proclaiming February 12th 2002 Reconciliation Day
in Ottawa, Mayor Bob Chiarelli was presented with an official certificate by
June Girvan, Volunteer-in-Chief
of the J’Nikira Dinqinesh Education Centre, and invited
to sign the Dinquinesh Record of Honour, dedicated to persons in Canadian
history who collaborated to establish freedom and promote social justice for
Black people, and to build social cohesion in our society.

in Recommendation 1, subject to a successful rezoning of the property and
subject to any easements that may be required, to the Conseil des écoles
publiques de l’Est de l’Ontario for the amount of $1,920,000.00 pursuant to an
Agreement of Purchase and Sale that has been received;
3. Direct staff to seek an exemption from

That Council approve the amendments
to the former City of Ottawa Zoning By-law, 1998, as detailed in
Document 1.

WHEREAS at its meeting of April 25, 2002, Planning and Development
Committee approved report ACS2002-DEV-POL-0006 regarding amendments to correct
anomalies in the former City of Ottawa Zoning
By-law, 1998;
AND WHEREAS the said report recommended a zoning by-law amendment to
correct an anomaly for the lands located at 610 Montreal Road, specifically
that the portion of 610 Montreal Road which is currently zoned CD F(2.0) be
rezoned to CD[628] F(2.0), in order to place the all of the commercially zoned
portions of these lands in identical CD[628] F(2.0) zoning;
AND WHEREAS the effect of this amendment is to allow access from the
R5A zoned lands to the south, across the subject lands, to Montreal Road, as
was permitted under previous
Zoning By-law Z-2K;
AND WHEREAS the subject lands are currently developed with
residential units that are now compatible with the residential uses to the
south, but due to the existing commercial zoning could be redeveloped for
commercial purposes in the future;
AND WHEREAS the said access could then be used by vehicles generated
by that commercial site to instead bring traffic through the residential
neighbourhood to the south, which was not the intent of this access provision;
BE IT THEREFORE RESOLVED THAT the following recommendation be added
to Document 1:
“ That Exception [628] be
amended to state as follows in Column IV, Provisions:
‘right-of-way originating from Montreal Road to serve the uses of
the R5A zoned portion of the lot, provided that the most southerly half of the
zone is used solely for one of the
residential land uses listed in and subject to the provisions of Section
324.’ ”
And that no further notice be given pursuant to Section 34(17) of
the Planning Act.

approve an amendment to the Former City of Ottawa Zoning By-law 1998 to
establish a building height limit of 20.3 m for the R6A [181] zone as it
applies to the property at 260-270 Besserer Street (which is the subject of
Report Reference ACS2002-DEV-APR-0069 for approval of a site plan application
for an apartment building with a height of
20.3 m), and that no further notice be provided pursuant to Section
34(17) of the Planning Act RSO 1990.

Committee Recommendation As Amended
Whereas the City of
Ottawa should determine it’s own transportation needs;
And Whereas a
comprehensive citywide multi-modal transportation master plan must be carried
out to determine the needs of Ottawa residents;
Therefore Be It
Resolved That the Transportation and Transit Committee recommend Council reject
the Statement of Work for the Joint MTO/Ottawa Provincial Highway Bypass Ring
Road Needs Assessment Study;
And Be It Further
Resolved That the Transportation and Transit Committee recommend Council take
the money, earmarked for this study and others being carried out in isolation,
and use it for a citywide multi-modal transportation master plan.

That the Committee Recommendations as amended
be replaced by the following:
WHEREAS a key
priority of the City of Ottawa is to address the immediate need to facilitate
the east-west movement of people and goods by the completion of the
Strandherd/Armstrong inner ring road and to move to create new interprovincial
crossings and;
WHEREAS
the continued success of the National Capital Region depends on the free
movement of people and goods between the Province of Ontario and the Province
of Quebec and that this success is being stifled by the congestion on the
existing interprovincial bridges and;
WHEREAS an environmental assessment of
potential new bridge crossings will include extensive traffic analysis
including a review of the traffic impacts on Highway 417 and Road 174 and;
WHEREAS there is a significant need to improve
the movement of people and goods to and from the easterly sector of the City
and;
WHEREAS the continued overuse of King Edward
Ave by heavy truck traffic is having a debilitating effect on the quality of
life of our downtown and;
WHEREAS there has not been a new bridge
connection over the Ottawa River in more than a quarter of a century and;
WHEREAS the City has built the Hunt Club Road
to act as a key transportation corridor that provides for the movement of
people and goods from east to west and;
WHEREAS the Hunt Club Road is currently
operating at capacity and;
WHEREAS the critical link for the City’s
continued economic viability is the inner ring road defined as the
Strandherd/Armstrong connection which will connect the fast growing communities
on either side of the Rideau River south of the Macdonald Cartier Airport and;
WHEREAS the
Ottawa Macdonald-Cartier Airport is undergoing an extensive expansion that will
become operational in 2004 that will require improved access and;
WHEREAS the Province of Ontario’s proposal to
review the need for an outer provincial Highway Bypass ring road identifies the
potential need for such a facility in 30 years from today and as this is well
beyond the City’s Official Plan horizon of 2020
BE IT THEREFORE RESOLVED that the City pursue
the environmental assessment of the Strandherd/Armstrong inner ring road
including dedicated transit lanes and that in cooperation with the City of
Gatineau and the National Capital Commission terms of reference be developed to
begin the Environmental Assessment of new interprovincial crossings that will
connect the existing road infrastructure on either side of the Ottawa River
and;
BE IT FURTHER RESOLVED that the City ask the
province of Ontario to defer its outer provincial highway bypass ring road
study until the completion of the environmental assessment of new
interprovincial crossings at which time the City will reconsider its
participation and financial contribution.

WHEREAS the use to which Federal lands are put within the City of
Ottawa is of significant interest to City government, especially as it effects
City services of these lands;
WHEREAS the National Capital Commission (NCC) and the Department of
Public Works and Government Services Canada (PWGSC) have traditionally, as a
courtesy to the City of Ottawa, complied with all municipal requirements when
developing or redeveloping federal government lands in the Nation’s Capital Region
(NCR);
WHEREAS the City of Ottawa’s policy for demolition of residential units
requires a Demolition Permit according to the former City of Ottawa Demolition
Control By-law;
WHEREAS an application for a Building Permit is required in order to
obtain a Demolition permit for residential units;
BE IT RESOLVED THAT the City of Ottawa request that the Department
of National Defence respect the practice established by PWGSC and the NCC and
that DND comply with all municipal requirements of the City of Ottawa in any
eventual federal government land development or redevelopment in the NCR –
including Canadian Forces Base (CFB) Rockcliffe land.
BE IT FURTHER RESOLVED THAT DND requests and obtains a Demolition
Permit from the City of Ottawa, as set out in the former City of Ottawa
Demolition Control By-law, prior to proceeding with the demolition of
residential units on federal government land in the NCR – including CFB
Rockcliffe land.

WHEREAS climate change causes drought, permafrost melting, sea-level rise
and floods that damage municipal infrastructure, displace citizens and create a
financial burden for municipal governments;
WHEREAS economic activity in rural and northern communities relying on
fisheries, tourism, forestry and agriculture is disrupted by climate change;
WHEREAS investments in building retrofits, community energy systems,
water conservation, renewable energy technologies, waste reduction, landfill
gas capture, fleet management and public transit reduce municipal
operating costs, help maintain community services and protect public health
while cutting greenhouse gas emissions contributing to climate change;
WHEREAS forestry and agriculture sectors can expand business
opportunities by increasing the capacity of trees and soils to absorb carbon
dioxide and by developing renewable fuels like ethanol;
WHEREAS fossil fuel producers are increasing investments in renewable
energy and alternative fossil fuel technologies that reduce the amount of
carbon dioxide going into the air; and
WHEREAS 78 per cent of Canadians (according to
poll results from Decima Research Inc., March 2002) want the Kyoto Protocol
ratified;
BE IT RESOLVED THAT the City of Ottawa endorses ratification of the Kyoto Protocol; and
BE IT FURTHER RESOLVED
THAT this resolution be communicated to our Members of Parliament, Provincial
Environment and Energy Ministers, Federal and Provincial Opposition Leaders,
community media and the Federation of Canadian Municipalities.

WHEREAS the city of Ottawa, through
its programs, activities and festivals strives to promote good sportsmanship;
AND WHEREAS major public gatherings
featuring professional athletes serve as role modelling functions;
AND WHEREAS unsportsmanlike
complaining about officiating after a loss sets a poor example for all;
BE IT RESOLVED THAT a 500 m area immediately surrounding the Corel
Centre be declared a “no cry” zone.

annual community event;

AND WHEREAS the noise generated from
the entertainment and rides are standard features of Barrhaven Days;
THEREFORE BE IT RESOLVED THAT the
provisions of the City of Nepean By-law 42-61 (noise) shall not apply to
preclude Barrhaven Days from providing entertainment involving sound
reproduction devices from June 6 – 9 inclusive.

That the
Rules of Procedure be waived to consider and approve the following Motion:
WHEREAS the Italian Week and St. Anthony’s Festival
will take place from June 7th until June 16th, 2002;
AND WHEREAS this Festival contributes significantly to
the Cultural mosaic of the City of Ottawa and tends to attract tourists and
participants to the City of Ottawa;
AND WHEREAS events will take place as part of the
Festival on June 7th, 8th and 9th at the
corner of Booth Street and Gladstone Avenue and on June 14th, 15th
and 16th on Preston Street;
AND WHEREAS these events are scheduled to take place
until 1:00 a.m. on June 7th, 8th, 14th and 15th
and until 12:00 a.m. on June 9th and 16th;
AND WHEREAS exemption from subsections 23(1) and 24(3)
of the old Corporation of the City of Ottawa Noise By-law Number 3-97 is
required to allow the use of sound reproduction devices which may surpass the
allowed 55 decibel level, but will not exceed 65 decibels, in effect until
11:00 p.m. or which may disturb the peace and comfort of a resident after 11:00
p.m.;
THEREFORE BE IT RESOLVED that the provisions of
subsection 23(1) and 24(3) of City of Ottawa Noise By-law Number 3-97 shall not
apply so as to preclude the use of sound reproduction devices during the
Italian Week and St. Anthony’s Festival, which may exceed 55 dBA, but will not
exceed 65 dBA, when measured at the property line of a business person or
person whose peace and comfort is disturbed before 11 p.m. or disturbs the
peace and comfort of a resident whose peace and comfort is disturbed after
11:00 p.m on the dates of June 7th, 8th, 14th,
and 15th, 2002, until 1:00 a.m. and on June 9th and 16th,
2002, until 12:00 a.m.

briefing pertaining to the Ambulance Dispatch tender document issued by the
Provincial Ministry of Health.

WHEREAS the Ministry of Health and
Long-Term Care has issued a Request for Proposals to operate the Central Ottawa
Ambulance Communication Centre (RFP No 2001-46);
AND WHEREAS the Council of the City of Ottawa believes that the City
is in the best position to ensure the health and safety of Ottawa residents in
relation to land ambulance dispatch services by operating the Ottawa Central
Ambulance Communication Centre;
AND WHEREAS there is a pending legal proceeding between the City and
the Province as a result of the Province, via the Ministry of Health and
Long-Term Care, issuing RFP No 2001-46;
AND WHEREAS the Council of the City of Ottawa believes that the best
way to ensure the health and safety of Ottawa residents in relation to land
ambulance dispatch services and to preserve the options available to the City
in this matter is to respond to RFP No 2001-46 under protest;
AND WHEREAS it is expedient and
necessary for staff to have authority to execute certain contracts, leases or
licence agreements on behalf of the City in order to permit the City to respond
to RFP No 2001-46 within the strict time frame set out for such response;
THEREFORE BE IT RESOLVED THAT the City of Ottawa respond to RFP No
2001-46 with a proposal and bid for service and that the same be noted as being
submitted “under protest”.
BE IT
FURTHER RESOLVED THAT the City Manager be given the delegated authority to
approve and execute, on behalf of the City, such response to the RFP No.
2001-46, and any necessary schedule(s), or appendices, thereto.
BE IT
FURTHER RESOLVED THAT the Director of Financial Services be given the delegated
authority to approve and execute, on behalf of the City, any declaration of the
City’s financial position, or other necessary financial documents, in response
to RFP No 2001-46.
BE IT
FURTHER RESOLVED THAT staff report back to Council on the outcome of the City’s
submission to RFP No 2001-46 when the results are known.
