DIRECTIVES DE RÉDACTION

RÈGLEMENT SUR LES EMPIÈTEMENTS

(Règlement no 2003-446, ainsi modifié)

 

 

1)      Modifier le règlement pour ajouter aux règlements généraux concernant les empiètements de terrasse (articles 74 à 91) l’obligation au détenteur de permis de veiller à ce que personne ne fume dans l’aire d’empiètement et qu’un panneau d’interdiction de fumer soit placé bien en vue.

 

2)      Modifier le Règlement sur les empiètements pour ajouter aux règlements généraux concernant les petites terrasses de café (articles 91H à 91U) l’obligation au détenteur de permis de veiller à ce que personne ne fume dans l’aire d’empiètement et qu’un panneau d’interdiction de fumer soit placé bien en vue.

 

3)      Ajouter une définition de « fumer » à l’article des définitions du règlement conformément à celle du Règlement sur les lieux publics – « fumer » ou « usage du tabac » – Tenir un cigare, une cigarette, une pipe allumés ou tout autre appareil servant à fumer du tabac allumé.

 

4)      Renseignements généraux

a)      Les modifications au règlement susmentionné comprendront toute révision mineure nécessaire pour leur donner effet.

b)      La date de mise en vigueur des modifications au Règlement sur les empiètements sera le 2 avril 2012.

Drafting Instructions

Encroachment By-law

(By-law No. 2003-446, as amended)

 

 

1)      Amend the by-law to add requirement to the general regulations regarding patio encroachments (Section 74 to 91) to require permit holder to ensure no smoking is permitted in the encroachment area and that a sign be posted in a visible location indicating that smoking is not permitted.

 

2)      Amend the Encroachment By-law to add a requirement to the general regulations regarding café seating (Sections 91H to 91U)  to require the permit holder to ensure that no smoking is permitted in the encroachment area and that a sign be posted in a visible location indicating that smoking is not permitted

 

3)      Add a definition of smoking to the definitions section of the by-law consistent with that of the Public Places By-law – “smoke or smoking includes the carrying of a lighted cigar, cigarette, pipe or other lighted smoking equipment.”

 

4)      General

a)      Amendments to the above-noted by-law shall include any minor revisions necessary to give effect to the amendments noted

b)      The effective date of amendments to the Encroachment By-law will be April 2, 2012.
