RÈGLEMENT SUR LES MARCHÉS

1) Modifier l’article 62 du Règlement sur le marché Parkdale (Règlement n^o 2008-448), concernant le comportement exigé d’un détenteur de permis, à l’effet que le détenteur de permis soit tenu de veiller à ce que personne ne fume dans l’étal et qu’un panneau d’interdiction de fumer y soit placé bien en vue.

2) Modifier l’article 60 du Règlement sur le marché By (Règlement n^o 2008-449), concernant le comportement exigé d’un détenteur de permis, à l’effet que le détenteur de permis soit tenu de veiller à ce que personne ne fume dans l’étal et qu’un panneau d’interdiction de fumer y soit placé bien en vue.

3) Ajouter une définition de « fumer » à l’article des définitions de chaque règlement conformément à celle du Règlement sur les lieux publics – « fumer » ou « usage du tabac » – Tenir un cigare, une cigarette, une pipe allumés ou tout autre appareil servant à fumer du tabac allumé.

4) Renseignements généraux

a) Les modifications au règlement susmentionné comprendront toute révision mineure nécessaire pour leur donner effet.

b) La date de mise en vigueur des modifications au Règlement sur les marchés sera le 1^er mars 2012 de sorte à coïncider avec la date de délivrance des permis de la saison des marchés 2012. Toutefois, le calendrier d’exécution établi dans le rapport s’appliquera.

Drafting Instructions

Markets By-laws

1) Amend Section 62 of the Parkdale Market By-law (By-law No. 2008-448) which section deals with the conduct of a permit holder and licensee to require the licensee or permit holder to ensure smoking is not permitted in the stand and that a sign be posted in a visible location indicating that smoking is not permitted.

2) Amend Section 60 of the ByWard Market Program By-law (By-law No. 2008-449) which section deals with the conduct of the permit holder and licensee to require the licensee or permit holder to ensure smoking is not permitted in the stand and that a sign be posted in a visible location indicating that smoking is not permitted.

3) Add a definition of smoking to the definitions section of each by-law consistent with that of the Public Places By-law – “smoke or smoking includes the carrying of a lighted cigar, cigarette, pipe or other lighted smoking equipment.”

4) General

c) Amendments to the above-noted by-law shall include any minor revisions necessary to give effect to the amendments noted

d) The effective date of amendments to the Markets By-laws will be March 1, 2012 in order to coincide with the issuance of permits for the 2012 market season. However, the enforcement timetable outlined in the report will apply.
