REPORT RECOMMENDATION

 

That License Committee consider the status of Mr. Victor Ibrahim’s Taxicab Driver’s License.

 

 

RECOMMANDATION DU RAPPORT

 

Que le Comité des permis examine les conditions du permis de chauffeur de taxi de M. Victor Ibrahim .

 

 

BACKGROUND

 

On September 10, 2003, Mr. Victor Ibrahim is alleged to have sexually harassed the complainant while operating as a licensed taxi driver.  The Chief License Inspector considers Mr. Ibrahim’s actions to be contrary to Section 28 of Licensing By-law L-6.

 

Additional information will be presented at the review hearing.

 


Relevant Provisions of Licensing By-law L-6

 

28.                   Every person applying for or holding a license under this by-law shall in such application or in carrying on or engaging in the trade, calling, business or occupation in respect of which the license is issued, observe, comply with and be governed by this by-law.

 

29.       (1)        The License Committee, after a hearing, may revoke any or each of the licenses held by a licensee for cause and without limiting the generality of the foregoing for:

(a)                a breach of the law,

(b)               anything which may be in any way adverse to the public interest,

(c)                any other matter which the License Committee is authorized by law to consider, or

(d)               any violation of the provisions of this by-law.

 

(2)        The License Committee may suspend a license for cause for any period that is less than the unexpired part of the period for which it was issued in lieu of revocation as provided in subsection (1) hereof.

 

(3)        The License Committee may recommend, in lieu of suspending or revoking a license, that conditions be imposed on the license as a requirement of the licensee continuing to hold or renewing the license.

 

            (4)        The Chief License Inspector may suspend for cause any license for two weeks or                      until the next meeting of the License Committee whichever occurs first, and upon                                   suspending any license shall notify the License Committee as to the suspension.

 

 

CONSULTATION

 

Mr. Ibrahim has been notified of the date and time of the hearing, and has been provided with a copy of this report.

 

 

FINANCIAL IMPLICATIONS

 

There are no financial implications associated with this report.

 

 

DISPOSITION

 

The Chief License Inspector to implement the decision of License Committee accordingly.
